18 NOV 27 SpecialCITY OF JACKSONVILLE, ARKANSAS SPECIAL PLANNING COMMISSION MEETING NOVEMBER 27, 2018 6:00 P.M. – 6:11 P.M. OPENING REMARKS: The Planning Commission of the City of Jacksonville, Arkansas met in a special session on November 27, 2018. Chairman Moore opened the meeting at approximately 6:00 p.m. expressing appreciation to those in attendance. ROLL CALL: Commissioners Patrick Thomas, Trisa Dabbs, Vivian Brittenum, Dan Brown, and Virgil Healey answered ROLL CALL. Chairman Jim Moore also answered roll call and declared a quorum. PRESENT (6), ABSENT (2) one position open. Others present for the meeting were Public Works Director Jim Oakley and interested citizens, petitioners, and press. CORRECTION AND/OR APPROVAL OF MINUTES: Commissioner Healey moved, seconded by Commissioner Brown to approve the minutes of the October 8, 2018 regularly scheduled meeting and the October 22, 2018 special meeting as presented. MOTION CARRIED. PUBLIC HEARING(S): a. CONDITIONAL USE 1931 West Main auto sales in a M-2 zone Chairman Moore noted that the assessor’s website shows the address as 1929 West Main Street. He asked that the record reflect the difference in address. City Attorney Bamburg stated that the legal description is the proper way to describe the properties. He then advised that a legal would need to be obtained for the record. Chairman Moore opened the public hearing at approximately 6:15 p.m. Petitioner Jason Colosimo stated that he plans to sell used vehicles and has no plans for maintenance other than detail and cleaning. He stated that he is not a mechanic and does not have the ability to perform any major mechanic work at the location. He added that he plans to outsource any mechanical work. He related that if any mechanical work is performed, brakes would be the most done and it would only be for the cars he plans to sell. He then answered Chairman Moore that he has sold vehicles in the past for other dealers, explaining that he has not applied for his dealer’s license because the process through the State Police has to be tied to the location. He stated that he has moved along in the process but was waiting for this permit before attaching his license to this address. He then answered that this is the first time he has applied for a dealer’s license for himself. Commissioner Healey questioned how can the Planning Commission approve the conditional use if they do not know what address it is going to be approved for. CITY OF JACKSONVILLE, ARKANSAS SPECIAL PLANNING COMMISSION MEETING NOVEMBER 27, 2018 6:00 P.M. – 6:11 P.M. City Attorney Bamburg stated that any approval would be applied to both 1931, which was presented by the applicant and 1929 West Main, which is the other address listed on County Assessor records. He stated that he was unable to find the State records because he does not have the corporate name used by Mr. McKay. He stated that the legal description is what the City should have and it needs to be a requirement that it be presented for the record prior to the conditional use being effective. He added that the any motion of approval needs to be conditional upon his requiring all licenses both from the State and local. Chairman Moore added along with the legal description being included in the minutes with any approval. In response to a question from Commissioner Healey, Mr. Colosimo answered that he would not perform oil changes at this location. He stated that he does not have the proper facilities to hold or dispose of oil. He clarified that he would not be disposing of any fluids. Chairman Moore closed the public hearing at approximately 6:20 p.m. Chairman Moore noted the previous tenant that sold vehicles at this location was parking vehicles next to Main Street, cautioning Mr. Colosimo that he would need to make sure his vehicles are not parked in the right-of-way of West Main Street. He asked for a motion regarding the property presented as 1931 West Main Street and known in the Assessor’s records as 1929 West Main Street along with the legal description to be filed with the minutes and all necessary licenses before operation of a car lot. Commissioner Healey moved, seconded by Commissioner Dabbs to approve the conditional use of auto sales operation conditional on proof of a proper address, proper licenses obtained and a legal description. MOTION CARRIED. LEGAL DESCRIPTION: A tract of land in the NW ¼, NE ¼ section 25, and in the SW ¼, SE ¼, section 24, Township 3 North, Range 11 West, Pulaski County, Arkansas, being more particularly described as follows: Starting at the Northeast corner of Section 25, T-3-N, R-11-W; thence N 88° 25’ W along the north line of said Section 25, 1827.1 feet; thence N 02° 57’ E, 92.5 feet to the south right-of-way line of West Main Street; thence N 87° 20’ W, 190.25 feet to the point of beginning; thence S 06° 49’ W, 242.5 feet; thence N 87° 28’ W, 172.88 feet to the centerline of Jacksonville – Northwestern Railroad; thence along said centerline of Railroad N 05° 14’ Economic, 242.5 feet to the south right-of-way line of West Main Street; thence S 87° 20’ E along said south right-of-way line, 179.45 feet to the point of beginning: Containing 0.98 acres, more or less.
