RESCHEDULED PLANNING COMMISSION MEETING
MARCH 26, 2018

OPENING REMARKS:
The Planning Commission of the City of Jacksonville, Arkansas met in a
rescheduled session on March 26, 2018. The regularly scheduled
Planning Commission meeting of March 12, 2018 was rescheduled due to
lack of a quorum. Chairman Moore opened the meeting at approximately
7:00 p.m. expressing appreciation to those in attendance.
ROLL CALL: Commissioners Patrick Thomas, Jim Peacock, Barbara
Mashburn, Vivian Brittenum, and Dan Brown answered ROLL CALL.
Chairman Jim Moore also answered roll call and declared a quorum.
PRESENT (6), ABSENT (1) two positions open.
Others present for the meeting were City Engineer Jay Whisker,
interested citizens, petitioners, and press.
CORRECTION AND/OR APPROVAL OF MINUTES:
Commissioner Mashburn moved, seconded by Commissioner Brittenum to
approve the minutes of the February 12, 2018 regularly scheduled
meeting. MOTION CARRIED.
PUBLIC HEARING(S): CONDITIONAL USE of C-3 in a C-2 zone located at 420
Dupree Drive
Chairman Moore opened the public hearing at approximately 7:08 p.m.
Petitioner Craig Mosely related that they are proposing to sell cars
by appointment from the location at 420 Dupree Drive. He explained
that presently they are selling cars online. He then related that both
he and his uncle have fulltime jobs so that is the reason they are
proposing to sell by appointment only. He noted that his uncle works
as a bail bondsman and contractor, while he is employed by the State
of Arkansas as a correction officer. He added that the business would
not be open every day but they would set appointments to sell the
cars. He went on to say they are proposing to have six to eight cars
on the lot.
Chairman Moore noted that the written request was for 15 cars.
Mr. Mosely answered that four to six cars could be parked on the
inside bay area. He then added that he feels they would only need
space for six to eight cars.
In response to a question from Councilman Mashburn, City Engineer
Whisker stated that he counted 9 outside spaces regarding the parking
lot. He clarified that there are 4 spaces in the front and then 5
spaces down the side of the building, adding that there is a space for
the entrance into the back bay.
Mr. Mosely confirmed with Commissioner Brittenum that he feels he
would have ample space for six to eight cars.

City Engineer Whisker stated that the area along Main, Dupree and
South James is a C-2 area and then Dupree rolls into First Street
(Hwy. 161) with C-3 in this area. He noted two other car lots in the
immediate area as well as Walker’s Radiators, which is a C-3 business
in a C-2 zoning.
Chairman Moore noted that Walker’s Radiator was grandfathered in
because the business has been there before the zoning was changed.
City Engineer Whisker stated that this lot lines up in the middle of a
C-2/C-3 area.
Councilman Mashburn confirmed with City Engineer Whisker that a C-3
use in this area would not be out of line with the other businesses in
the area.
City Engineer Whisker explained that as a conditional use it would go
along with the business and would cease if the business were to stop
existing and would revert back to C-2.
Chairman Moore questioned if the four spaces in the front would impede
vehicles being parked on the side and if the vehicles on the side
would impede vehicles being parked on the inside.
City Engineer Whisker explained that the spaces in the front are
directly straight to the street and the spaces on the side are at a
60° angle and a vehicle can drive around the vehicles parked on the
side of the building. He surmised that if they were to install double
doors on the front of the building then they would have to move a car
or two to gain access.
Chairman Moore questioned if the 9 available parking spaces would
include customer and employee parking.
City Engineer Whisker reiterated that there are a total of 9 spaces.
Chairman Moore questioned compliance with ADA.
City Engineer Whisker stated that obviously a business would need to
have some customer parking and ADA parking would require at least 1
space.
Chairman Moore noted that currently there is not a space for ADA
parking.
City Engineer Whisker stated that the lines for parking spaces are
barely visible, adding that they would have to be repainted.
Commissioner Thomas moved to approve the conditional use of C-3 in a
C-2 zone at 420 Dupree Drive.

Chairman Moore opened the floor for comments for or against the item
in request.
With no one to speak, Chairman Moore closed the public hearing at
approximately 7:16 p.m.
Commissioner Thomas moved seconded by Councilman Mashburn to approve
the conditional use of C-3 in a C-2 zone at 420 Dupree Drive.
Chairman Moore questioned if the motion included any conditions
regarding the approval. He reminded the Commission that the original
request stated that they would like to have an inventory and spaces
for 15 vehicles outside and 4 inside the overhead door area, which
totals 19 spaces. He continued saying that now the petitioner is
saying he wants six to eight cars with some in the back.
Commissioner Thomas stated that he does not want to impose any
conditions on the approval.
Commissioner Brown stated that he had visited the area, saying that he
noticed there was another car lot down the street. He questioned if
this request would add or benefit the City of Jacksonville to have
another auto dealer so close to another one that does not appear to be
doing that well. He then pointed out that the original application is
for one thing and then suddenly the Commission is being asked to vote
on something that is very different. He noted the information
regarding a window tinting business.
It was clarified that the additional information in the packet is a
history from a different request that came before the Planning
Commission from a separate petitioner.
Chairman Moore stated that Commissioner Brown’s question was a good
one, adding that there needs to be a condition attached because when a
vehicle sales lot is approved there is a tendency for maintenance. He
then questioned Mr. Mosely as to any kind of proposed maintenance or
detailing that would be done onsite.
Mr. Mosely answered that Warren Robinson in North Little Rock would
take care of all maintenance or mechanic work.
Chairman Moore stated Chairman’s privilege, saying that one condition
that needs to be added is that no major maintenance type of work would
be done onsite and no detailing that would involve an environmental
issue because of disposal requirements.
Commissioner Thomas reiterated his desire not to attach any conditions
to the approval, adding that regarding maintenance, he would not
object to maintenance such as changing tires or change the oil as long
as he complies with any EPA regulations. He mentioned regulations for

steam cleaning or washing of vehicles, pointing out that Mr. Mosely
has not stated that he would be doing any cleaning that would produce
oil runoff. He went on to say that washing a car in the parking lot is
no different from any other car lot or detail shop in this City. He
stated that he does not see any reason for putting a stipulation on
the approval. He stated that there are dozens of car lots in town
that are not doing anything different than what Mr. Mosely is
proposing to do.
Chairman Moore clarified that is the reason he questioned Mr. Mosely
plans for detailing or having maintenance work.
