REGULAR PLANNING COMMISSION MEETING
SEPTEMBER 11, 2017

OPENING REMARKS:
The Planning Commission of the City of Jacksonville, Arkansas met in
regular session on September 11, 2017. Chairman Moore opened the
meeting at approximately 7:00 p.m. expressing appreciation to those in
attendance.
ROLL CALL: Commissioners Jim Peacock, Jr., Scott Scholl, Rick White,
Robert Price, Virgil Healey answered ROLL CALL. Chairman Jim Moore
also answered roll call and declared a quorum. PRESENT (6), ABSENT
(3).
Others present for the meeting were City Engineer Jay Whisker, Patrick
Melikian, Geneva Healey, interested citizens, petitioners, and press.
CORRECTION AND/OR APPROVAL OF MINUTES:
Commissioner Healey moved, seconded by Commissioner White to approve
the minutes of the August 14, 2017 regularly scheduled meeting as
presented. MOTION CARRIED.
PUBLIC HEARING(S): REZONING 7418 T.P. White Drive from C-5 to C-3
Chairman Moore opened the public hearing at approximately 7:05 p.m.
Petitioner Patrick Melikian representing Denovo Properties, LLC d.b.a.
Apex Auto Group, stated he is a managing member of the Group. He
related that the property is still zoned C-5, which is for alcohol
sales. He assured the Commission that he has no intention of ever
distributing or selling alcohol, explaining that he imagines that the
Commission would not have a problem removing that property designation
especially in that area. He related that he is currently renovating
the property; he produced photographs of the property’s renovation
progress. He stated that the property was purchased slightly over one
month ago, explaining that the intention is for this property to be a
higher end used automobile dealership. He demonstrated the condition
the property was in when it was purchased and then explained his
renovation plans. He added that he has been working with City
Engineer Whisker regarding their plans. He noted that the front on
either side of the entrance would have large commercial windows,
adding that the black top would be recoated and sealed, along with new
signage and landscaping. He stated that their intentions are to dress
the property up and make it aesthetically pleasing. He reviewed that
the immediate surrounding property is zoned Highway Commercial C-3 and
pointed out the two locations away from this property that is zoned
for alcohol sales. He stated that he believes the requested rezoning
is in concurrence with the surrounding properties and is consistent
with the Comprehensive Plan and Jacksonville’s Master Land Use Plan.
With no one else to speak either pro or con, Chairman Moore closed the
public hearing at approximately 7:09 p.m.

City Engineer Whisker recalled that the C-5 zoning came about when the
property was annexed in the North Corridor Annexation in 2011. He
explained that the specific zoning was in order to allow each of the
existing package stores to continue selling alcohol, without other
package stores moving in without first obtaining a rezoning for
alcohol. He noted that the property was previously operating as Busy
Bee Liquor and was zoned C-5 at the time of the annexation.
In response to a question from Commissioner Price, City Engineer
Whisker answered that typically if there is 25% or less done in
renovations, the building permit would only go through his office. He
explained that the costs of the current renovations does not mandate
them to come before the Planning Commission for a building permit
regarding the parking lot and sidewalk. He stated that he feels that
at some point if the business is successful, Mr. Melikian will be
required to come back before the Planning Commission if he wants to do
those things.
Mr. Melikian assured Commissioner Price that there would not be
automobile repairs or service work done at this site, it would be
strictly for sales. He stated that they may change a battery to get a
car front line ready, adding that they would use the existing loading
bay that has an existing drainage system for detailing purposes. He
reiterated that there would not be any service work or any oil
products to be disposed of on the property.
Commissioner Scott moved, seconded by Commissioner Healey to approve
the rezoning of 7418 T.P. White Drive from C-5 to C-3 as requested.
MOTION CARRIED.
