REGULAR PLANNING COMMISSION MEETING

OPENING REMARKS:
The Planning Commission of the City of Jacksonville, Arkansas met in
regular session on May 12, 2014. Chairman Ott opened the meeting at
approximately 7:00 p.m. expressing appreciation to those in
attendance.
ROLL CALL: Commissioners Jim Peacock, Jr., Scott Scholl, Jim Moore,
Joe Cummings, Jr., and Rick White answered ROLL CALL. Chairman Ott
also answered roll call and declared a quorum. PRESENT (5), ABSENT
(3).
Others present for the meeting were City Engineer Jay Whisker, Michael
Clayton, interested citizens, petitioners, and press.
CORRECTION AND/OR APPROVAL OF MINUTES: Commissioner White moved,
seconded by Commissioner Cummings, Jr. to approve the minutes of the
April 14, 2014 regularly scheduled meeting as presented. MOTION
CARRIED.
PUBLIC HEARING(S):
REQUEST TO APPROVE PLAT(S): SKETCH PLAT Max Pointe Subdivision
Representative Michael Clayton of Clayton Engineering related that
last month the Planning Commission discussed the Master Street Plan
regarding this subdivision, adding that they have returned with the
Sketch Plat they feels best works with the Master Street Plan and
which allow them to reasonably develop the property for a residential
subdivision.
He illustrated on a PowerPoint presentation the Master Street Plan,
the future proposed extension of West Main Street and how it would tie
in at the northwest corner close to the Church. He stated that the
proposed curves meet the standards of a minor arterial street,
explaining that there is a 600’ radius with a minimum of 200’ tangent
between curves. He stated that they have no issue meeting those
standards. He mentioned the previous concerns regarding Emma Street
and the transition back to the existing street. He stated that they
are proposing an intersection design that will allow the transition of
Emma Street to the north. He related that they are proposing to
construct Emma Street as shown on the plat, explaining that it would
require a temporary road where it ends at the proposed right-of-way of
West Main Street and construct a connection directly onto the corner
until West Main Street extension is built and then the transition back
to Emma Street could take place.
He then referred to the R-0 zoning, noting they have lots that are
less than the minimum 70 feet. He added that he would like to have
the flexible to return with a rezoning request to R-1 or allow the
concept design with 70-foot lots to comply with the R-0 requirements.
He stated that they would return with a full set of plans regarding
the water, streets, and drainage with the preliminary plat.

City Engineer Whisker related that the proposed sketch plat meets the
requirements of the Master Street Plan. He related that Emma Street
leads into Bushwood, explaining that when the West Main extension is
built, Emma Street will continue onto what is part of West Main before
the curve and turn onto the Subdivision. He stated pointed out that
Emma Street cannot be built until the West Main Cutoff is built. He
clarified that the developer’s proposal is to build Emma Street to the
south right-of-way line of where the new West Main Street would go and
would be a temporary road, probably 24’ wide, 2” asphalt on 6” base
but without curb and gutter. He reviewed that the zoning is R-0,
which is 70’ X 120’ minimum, adding that R-1 is 60’ X 100’ a
difference of 1200 square foot. He stated that the lots will have to
comply or the property will have to be rezoned. He then added that
there are only a few lots that do not meet the R-0 minimum.
In response to a question from Commissioner Peacock, City Engineer
Whisker confirmed that on the south end of the street it would dead
end. He stated that the developer would have to build a hammerhead
turnaround for the garbage trucks or obtain an easement from Mr.
Dupree and construct a temporary rock turnaround. He cited the same
circumstance on Puritan Drive being developed by Dickie Jones, and
noted other street with this same feature.
In response to a question from Commissioner Moore, City Engineer
Whisker noted that Max Cove would access Main Street from the new
temporary road, which will be inside the rights-of-way of Emma and the
new West Main Streets. He then clarified that the street would be
temporary until the new West Main Street is completed; adding that he
feels the developer is proposing no curb or gutter.
Chairman Ott clarified that the proposed lot 1 is approximately 31’
offset difference from what the zoning requirement is. Other
discussion ensued regarding the reconfiguration of lots to meet the
current zoning or return with a rezoning request.
City Engineer Whisker noted that the sketch plat typically does not
get into that much detail, adding that the idea is if the Planning
Commission agrees with the general layout design. He stated that he
believes it will be two month or more before all the engineering work
is at a point where the preliminary plat can be submitted. He then
assured Chairman Ott that the proposed width of Emma Street would
support the Master Street Plan concept for traffic.
Commissioner White moved, seconded by Commissioner Moore to approve
the sketch plat of Max Pointe Subdivision if brought into zoning
compliance and has the temporary turnaround on the end of Emma Street.

GENERAL: Approval of the new Planning Jurisdiction Map
City Engineer Whisker explained that the State legislature changed the
outside city jurisdiction from 5 miles to 1 mile. He presented a map
of the new Planning Jurisdictional Map, adding that it needs to be
adopted as a matter of record for the State. He went on to say that
he has not ever considered extending the area into Lonoke County,
noting that it would involve a different County Judge. He stated that
the only purpose in looking at Lonoke County would be where the school
district students are. He stated that this would be the area off
Military Road over to the east. He related that unless the Planning
Commission has any objection, he is proposing that the jurisdictional
map stop at the Pulaski County line except for the Lonoke County area
where Jacksonville’s school district is located the southeast corner
of the City. He stated that the rest is drawn on halfway lines with
Sherwood. He mentioned that Sherwood has already adopted their map
with the halfway lines between them and Jacksonville.
Chairman Ott questioned if Jacksonville still controls the footprint
of the runway for the Air Base.
City Engineer Whisker related that State law provides for that, adding
that his understanding is that even though some of the property is in
Sherwood, Jacksonville’s planning jurisdiction still controls that
area even though Sherwood annexed some of the area in the AICUZ zone.
He demonstrated the proposed jurisdictional lines of Sherwood and
Cabot. He explained the circumstance of Cabot claiming part of the
jurisdictional area belonging to Jacksonville, saying that if it were
disputed then the city closest to any development in the area has
jurisdiction. He reiterated his desire to include the small area in
Lonoke that has Jacksonville district students.
City Attorney Bamburg stated that a recommendation from the Planning
Commission would be forwarded to the City Council for adoption. He
added that even though City Engineer Whisker has made the
recommendation not to go pass the Lonoke County line, he would like to
ask the Planning Commission to include that area past the Pulaski
County line. He added that it should include the area into the north.
He went on to say with all things considered, he feels the City of
Jacksonville needs to go broader.
City Engineer Whisker stated that including those areas would be fine,
saying that it would affect his scope.
It was clarified that this would include the maximum limits in the
northeast end.
City Engineer Whisker noted that Cabot and Jacksonville would have
overlapping areas. He answered that it would not affect the hunting
area around Holland Bottoms, explaining that a planning jurisdiction

outline only provides that anyone planning to develop property within
that boundary would have to bring those development plans before the
Planning Commission. He stated that it controls development in the
County so that if a City were to annex the property it would already
conform to City standards. He then answered that his reason for not
proposing an extension into the Lonoke County area was a matter of
personal preference. He noted that recently in the newspaper, Cabot
decided that they wanted to extend into Pulaski County. He stated
that the Cabot Planning Commission issued an across the board 1 mile
planning jurisdiction including areas in Pulaski County. He then
answered if Jacksonville adopted a full 1 mile, it would extend to the
other side of Hwy. 5.
Commissioner White moved, seconded by Commission Moore to recommend
approval of the planning jurisdictional area extending to the maximum
1-mile surrounding Jacksonville. MOTION CARRIED.
