REGULAR PLANNING COMMISSION MEETING
JUNE 18, 2014

OPENING REMARKS:
The Planning Commission of the City of Jacksonville, Arkansas met in
regular session on June 18, 2014. Chairman Ott opened the meeting at
approximately 7:00 p.m. expressing appreciation to those in
attendance.
ROLL CALL: Commissioners Jim Peacock, Jr., Scott Scholl, Jim Moore,
Avis Twitty, Rick White, Eric McCleary answered ROLL CALL. Chairman
Ott also answered roll call and declared a quorum. PRESENT (6),
ABSENT (2).
Others present for the meeting were City Engineer Jay Whisker,
interested citizens, petitioners, and press.
CORRECTION AND/OR APPROVAL OF MINUTES: Commissioner White moved,
seconded by Commissioner Peacock to approve the minutes of the May 12,
2014 regularly scheduled meeting as presented. MOTION CARRIED.
PUBLIC HEARING(S): a. REZONING from R-6 to R-3 Lots 3, 4, & 5, Block 3
Bomber Base Addition
Mr. Tyler Turchi stated that he plans to purchase the lots contingent
on them being rezoned. He showed a photograph of an apartment complex
that he just purchased on lots 8 & 9, explaining that the construction
resembles a house more than typical apartment construction. He
explained that his intention is to duplicate the construct style for
these lots. He stated that this type of construction would better suit
the neighborhood, which is predominately residential. He then related
that he also owns lots 6 & 7 that related directly behind the six-plex
on lots 8 & 9. He stated that the previous owner, Mr. Hicks came
before the Planning Commission a few years ago and had lots six thru 9
rezoned to R-3. He stated that lots 3, 4, & 5 are adjacent to these
lots and the sell is contingent on the lots being rezoned to R-3.
In response to a question from Commissioner Moore, Mr. Turchi stated
that he would like to construct three more six-plexes on the remaining
vacant lots, if the property is rezoned. He explained that he is
proposing to construct 2,000 square feet units. He stated that he
feels that the success of the present apartment units is because it is
located between a big multi-unit apartment complex and a residential
area. He stated that the construction is more like a large home
instead of an apartment type construction, which adds to the success
of the units. He went on to say that is why he is proposing to
construct three separate units instead of one great big building. He
stated that he wants the construction to match the existing units,
only newer. He then clarified that he would utilize lots 6 & 7 along
with the lots to be rezoned to construct the three separate units. He
related that he has completed the purchase of lots 6 & 7 from Mr.
Hicks.
Chairman Ott closed the public hearing at approximately 7:07 p.m.

Mr. Turchi then answered Commissioner Moore that the current unit
utilizes the automated City garbage pickup service, so he plans to
continue that with the newer units.
City Engineer Whisker pointed out that the Sanitation Ordinance would
direct if they could continue with City pickup or if because of the
larger size of the complex they would have to contract to have a
dumpster made available for the tenants.
Mr. Turchi agreed to contract for a dumpster if it is determined that
is what the Ordinance requires.
Commissioner Moore pointed out that if a dumpster were required, it
would need to be screened.
City Engineer Whisker related that the existing apartment unit is
located on the first two lots at the corner of Plummer Drive and
Northeastern Avenue. He stated that depending on the construction
layout of the three other units, the lots may have to be replatted.
Commissioner Moore moved, seconded by Commissioner White to recommend
to the City Council the rezoning of lots 3, 4, & 5, Block 3 Bomber
Base Addition from R-6 to R-3 as requested. MOTION CARRIED.
City Engineer Whisker confirmed with Mr. Turchi that the City Council
would hear the recommendation to rezone the property at their

regularly scheduled July 3 meeting.
b. CONDITIONAL USE of R-1 for multi-family regarding property at 146
Dennis Lane
Chairman Ott recognized the petitioner as Ma Laticia Arias.
Mr. Joey Price introduced himself, stating that Ma Laticia Arias Perez
is currently renting a space at the Cloverdale Trailer Park. He
explained that he is the owner of that Park.
Ms. Perez introduced herself explaining that her husband has passed
away.
Chairman Ott questioned what her plans for the lot regarding multi-
family use.
Ms. Perez stated that she does not speak English very well, so she
directed the questions to a friend from her church.
Ms. Perez’s friend introduced herself as Gloria Perez, offering that
she would translate.

Mr. Price explained that there are three family members renting from
him at Cloverdale Mobile Home Park. He added that the property on
Dennis Lane was purchased and Ms. Perez is hoping to move the three
trailers to Dennis Lane in order to keep the family there as a unit.
He noted that her father and brother are in attendance and would be
the other family members moving to the property.
City Engineer Whisker explained that in 2001, the City zone property
regarding mobile homes as either single mobile home or mobile home
parks. He stated that currently this property is zoned only for a
single mobile home. He related that Ms. Perez thought that she could
put three mobile homes on the property, not understanding that it was
zoned for only one mobile home. He related that Ms. Perez has stated
that she has a child and wants the child to be raised with the help of
her father and brother as a family unit. He stated that the easiest
way to address the request was to offer a conditional use of the three
mobile homes on the property, but to be owned solely and only by the
family members. He added that if any family member moved from the
property, then the mobile home unit would also have to be taken off
the property. He noted that part of the backup documentation included
letters of request from the brother and father.
In response to a question from Chairman Ott, City Engineer Whisker
concurred that the mobile homes being moved onto the Dennis Lane
property would have to meet current City code for mobile homes.
Chairman Ott then clarified with Ms. Perez that there is not intent to
rent to other family members in the future.
Chairman Ott closed the public hearing at approximately 7:15 p.m.
It was clarified that the request is for three mobile homes to be
moved onto the property, the mobile home already located on Dennis
Lane is not a part of this parcel of land.
Commissioner White moved, seconded by Commissioner Moore to approve
the Conditional Use request for three mobile homes to be moved onto
the property address as 146 Dennis Lane with the units being addressed
as 146-A, 146-B, & 146-C Dennis Lane. This approval is strictly given
to Ma Leticia Arias to occupy one mobile home, J. Manual Arias
Arreguin to occupy one mobile home, and Jose Salvador Arias to occupy
one mobile home. Approval is restricted to these family members and
is not intended to extend to another family member if one of the
aforementioned family members moves from the property. All mobile
homes will comply with current City codes. MOTION CARRIED.
