REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in regular session on July 16, 2020 at the regular meeting place of the City Council. Council Member Bolden delivered the invocation and Mayor Johnson led a standing audience in the “Pledge of Allegiance” to the flag. ROLL CALL: City Council Members: Bolden, Sipes, Sansing, Ray, Mashburn, Twitty, Smith, and Collins answered ROLL CALL. Mayor Johnson also answered ROLL CALL declaring a quorum. PRESENT EIGHT (8) ABSENT (1) ONE SEAT VACANT. Others present for the meeting via teleconference were: City Attorney Stephanie Friedman, Public Works Director Jim Oakley. There were no members of the press present. PRESENTATION OF MINUTES: Mayor Johnson presented the minutes of the regular City Council meeting of June 18, 2020 for approval and/or correction at the next regularly scheduled City Council meeting. APPROVAL AND/OR CORRECTION OF MINUTES: Council Member Bolden moved, seconded by Council Member Twitty that the minutes of the regular scheduled City Council meeting of 21 May 2020 be APPROVED. MOTION CARRIED. CONSENT AGENDA: REGULAR MONTHLY REPORT/POLICE DEPARTMENT Council Member Twitty moved, seconded by Council Member Sansing to approve the Regular Monthly Report for June 2020 regarding annual crime statistical comparisons. WATER DEPARTMENT: DEVIATION IN AGENDA: STREET DEPARTMENT: Request to Accept Bid for Hill Street Drainage Improvements Council Member Bolden requested that Public Works Director Jim Oakley notify the residents on Hill Street that the drainage issues that have plagued the neighborhood will now be corrected. Public Works Director Jim Oakley stated that the proposed drainage will be a square concrete box culvert that has a hundred plus years shelf life. He noted that this would replace the round metal pipe that have begun to leak. He then answered Council Member Twitty that the City has used the low bidder in the past, noting that there were two main companies in the State that bid the project and both are reputable. Council Member Bolden moved, seconded by Council Member Twitty to approve the low bid from Scurlock Industries in the amount of $38,782.80 with funds to be drawn from the Street Fund. MOTION CARRIED. COMMITTEE(S): Used Car Lot Committee (Council Member Mashburn) No committee report to present. GENERAL: a. RESOLUTION 796 (#7-2020) JACKSONVILLE, ARKANSAS IS ESSENTIAL: IN SUPPORT OF FAIR DIRECT FEDERAL EMERGENCY SUPPORT TO REOPEN AND REBUILD LOCAL AMERICAN ECONOMIES. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING JULY 16, 2020 6:00 P.M. – 6:20 P.M. Mayor Johnson related that the Resolution was a request from the National League of Cities, asking cities to support this effort to offer some relief during the COVID-19 pandemic. Council Member Bolden moved, seconded by Council Member Twitty to read Resolution 796. MOTION CARRIED. Whereupon City Attorney Friedman read the heading of Resolution 796. Council Member Bolden moved, seconded by Council Member Twitty to approve and adopt Resolution 796 (#07-2020) in its entirety. MOTION CARRIED. b. RESOLUTION 797 (#08-2020) A RESOLUTION IN SUPPORT OF THE JACKSONVILLE CHAMBER OF COMMERCE’S “RESPECT AND PROTECT, WEAR A MASK” INITIATIVE. Council Member Twitty moved, seconded by Council Member Bolden to read Resolution 797. MOTION CARRIED. Whereupon City Attorney Friedman read the heading of Resolution 797. Council Member Twitty moved, seconded by Council Member Bolden to approve and adopt Resolution 797 (#08-2020) in its entirety. MOTION CARRIED. c. ORDINANCE 1634 (#08-2020) AN ORDINANCE BY THE CITY OF JACKSONVILLE, REGARDING THE USE OF MASKS IN RELATION TO THE COVID-19 PANDEMIC. Mayor Johnson stated that in light of the Governor’s order that will be enacted on Monday regarding the mandatory use of masks in public, he asked Council Member Twitty to address the City Council. Council Member Twitty pulled he Ordinance from the agenda. Council Member Bolden agreed to withdraw at this time. RESUME AGENDA: WASTEWATER DEPARTMENTS: ORDINANCE 1635 (#09-2020) AN ORDINANCE PROVIDING FOR THE ISSUANCE AND SALE OF WASTEWATER REFUNDING REVENUE BONDS, SERIES 2020 (FEDERALLY TAXABLE), IN ONE OR MORE SERIES, FOR THE PURPOSE OF REFUNDING THE CITY OF JACKSONVILLE, ARKANSAS WASTEWATER REFUNDING REVENUE BONDS, SERIES 2016B (NON-AMT); PROVIDING FOR THE PAYMENT OF THE PRINCIPAL OF AND INTEREST ON THE BONDS; PRESCRIBING OTHER MATTERS RELATING THERETO; AND DECLARING AN EMERGENCY. Council Member Twitty moved, seconded by Council Member Mashburn that Ordinance 1635 be placed on FIRST READING. ROLL CALL: Councilman Bolden, Sipes, Sansing, Mashburn, Twitty, Smith, and Collins voted AYE. MOTION CARRIED. City Attorney Friedman read the heading of Ordinance 1635 (#09-2020). CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING JULY 16, 2020 6:00 P.M. – 6:20 P.M. Senior Vice President with Stephens Inc., Ms. Leigh Ann Biernat explained that this was originally started in February 2020 but with COVID-19 things were stalled and the Market moved away in favor. She then added that she is happy to report that the taxable Market does look favorable once again for Wastewater to move forward with the venture. She stated that early indications are that this would save the Wastewater Utility over 1 million dollars over the life of the bond issue. She stated that Ordinance 1635 sets the parameters for the financing, adding that they would return in August with a Resolution that would demonstrate the exact results and that the venture met its parameters. Council Member Bolden moved, seconded by Council Member Sansing to approve Ordinance 1635 on FIRST READING and SUSPEND THE RULES to place Ordinance 1635 on SECOND READING. ROLL CALL: Councilman Bolden, Sipes, Sansing, Mashburn, Twitty, Smith, and Collins voted AYE. MOTION CARRIED. Council Member Twitty moved, seconded by Council Member Bolden to further SUSPEND THE RULES and place Ordinance 1635 on THIRD AND FINAL READING. ROLL CALL: Councilman Bolden, Sipes, Sansing, Mashburn, Twitty, Smith, and Collins voted AYE. MOTION CARRIED. Council Member Bolden moved, seconded by Council Member Twitty to APPROVE AND ADOPT Ordinance 1635 in its entirety. Council Member Twitty moved, seconded by Council Member Bolden that the EMERGENCY CLAUSE be approved and adopted. ROLL CALL: Councilman Bolden, Sipes, Sansing, Mashburn, Twitty, Smith, and Collins voted AYE. MOTION CARRIED. ORDINANCE 1635 (#09-2020) APPROVED AND ADOPTED THIS 16th DAY OF JULY, 2020. MOTION CARRIED. WATER COMMISSION: Council Member Twitty moved, seconded by Council Member Mashburn to approve the appointment of Timothy D. Thomas, Jr. to serve the unexpired term of John Davis to expire on April 20, 2022. MOTION CARRIED. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING JULY 16, 2020 6:00 P.M. – 6:20 P.M. ANNOUNCEMENTS: ARKANSAS MUNICIPAL LEAGUE CONFERENCE Mayor Johnson related that this meeting would be an online virtual meeting and would be free. He explained that each Council Member could register themselves or his office could do the registration. Mayor Johnson explained that the use of face masks protects the other person, asking everyone to social distance and wear face masks. Council Member Collins stated that he has some input for the minutes. He stated that in the minutes on page six at the top; there was not a roll call vote but it is written like a cross between a roll call and not, for the Planning Commission appointment. Council Member Ray asked that his presence be recorded and consented to all business items.
