REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in regular session on February 6, 2020 at the regular meeting place of the City Council. Council Member Bolden delivered the invocation and Mayor Johnson led a standing audience in the “Pledge of Allegiance” to the flag. ROLL CALL: City Council Members: Bolden, Sipes, Sansing, Ray, Traylor, Twitty, Smith, and Collins answered ROLL CALL. Mayor Johnson also answered ROLL CALL declaring a quorum. MOTION CARRIED. Whereupon City Attorney Friedman read the heading of Ordinance 1627. Public Works Director Jim Oakley related that the current ordinance has not been updated for forty years, explaining that there are two major changes; one is the design of pipes. He related that currently the ordinance states a five-year rain event and now we need a twenty-five-year rain event, adding that currently that is what all engineering firms design for. He then related that the other amendment will be a requirement that it be sent in digital format verses just paper. He informed the City Council that this would allow the Engineering Department to map the drainage system, which was supposed to have been done 20 years ago. He then pointed out that this update will allow the City to be eligible for grants. In response to a question from Mayor Johnson, Public Works Director Jim Oakley stated that developments do not have open ditches with guard rails, pointing out that all subdivisions have curb and gutter. He then noted that Foxwood Estates is however, the exception to that rule. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING FEBRUARY 6, 2020 6:00 P.M. – 6:49 P.M. Public Works Director Jim Oakley assured the City Council that this update would bring the City into compliance, allowing us to be eligible for grants. He related that the Pagis and County GIS program that the City participates in has a small fund for grants; adding that the other cities have taken advantage of it and they are saving it for us if we move forward with the update. Councilman Bolden moved, seconded by Councilman Sipes to approve Ordinance 1627 on FIRST READING and SUSPEND THE RULES to place Ordinance 1627 on SECOND READING. Mayor Johnson stated that the special election would be held April 14th and the filing period would run from February 10th to February 20th @ noon. He noted that the Election Commission has to mail the ballots 45 days prior to the election. DISCUSSION: Judge Rita Bailey to address concerns regarding the Courts building Judge Bailey explained that she is here because she has concerns regarding the Courts & Police building. She stated that she had provided a handout and turned it to the page regarding the mold testing. She explained that last year she had a lot of allergy problems and had inquired in December about having some mold testing. She stated that the mold testing concluded that there was some remediation that needed to be done. She stated that her concern is not so much with having the remediation done, but in the process what they did constituted some additional remodel actions. She then stated that some of the remediation for the mold that was done by City employees who pulled up some old carpet and switched out a lot of ceiling tiles as well as closed up a wall. She stated that they did a lot of things that constituted remodeling and she is not sure what came about regarding that but the plan she submitted was what should have been done to remediate the mold. She referred to the next exhibit indicating other things being done according to Public Works Director Jim Oakley. She stated that she feels the reason they were doing some of the remodeling is because the building is really in bad shape. She stated that she cannot say they meant any harm by ripping the carpet up and changing the ceiling tiles but the problem there is a State regulation that requires them to have a thorough asbestos inspection prior to moving forward. She stated that it was done without having the inspections and somebody called in a report and the State served her on January 6th regarding an asbestos report. She related that this raised some concerns for her because she was aware of the mold issue. She told the State that she had not heard anything about the asbestos and inquired as to any other information. She stated then referred to an exhibit regarding a limited asbestos report regarding what they saw at that point. She added that part of her concern is her health and the safety and welfare of those that use the building. She stated that she feels the highest degree of responsibility by having to order people to be in that building when there may have been some issues that may have disturbed some asbestos. She related that with the carpet being taken up and changing ceiling tiles that raises some major concerns for her. She added that initially, she has attempted to address CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING FEBRUARY 6, 2020 6:00 P.M. – 6:49 P.M. this issue of concern with the Mayor and Mr. Oakley as well as Lieutenant Hibbs, and had meetings with them. She continued saying that she pointed out to them that the report recommends that the floor tiles at the front door and rear entrance, being high traffic areas, that it should probably be removed. She stated that still her concern kept being with the regulation that the State served her, saying that before any type of renovations was done, that a thorough asbestos report should be done. She continued saying that she brought this to the attention of the Mayor and Mr. Oakley several times, adding that she had a meeting with them and she kept saying that she knew this was going to be an issue but wanted to get this resolved. She then explained that at some point, she felt they had reached an impasse, which really concerned her. She stated initially the argument was that they were not remodeling, saying that she has issues with that, saying that they kept saying that no tile was actually disturbed. She said that there is a picture. She stated that some of the other things are particle board and possibly some roofing materials that were pulled, subsequent to that the State came back out and they indicated that there was some work being done on the roof and that it needed to be tested. She stated that she was unable to get anything done; and was getting more and more concerned. She referred to her handout, noting that finally it looks as if Thursday of last week, the States lawyer wrote a letter that indicated that the City of Jacksonville had probably incurred significant fines or penalties thus far and ask the City to stop with the remodeling project until they got a thorough asbestos inspection. She related that during the entire time she had shared with the Mayor, Mr. Oakley and Lieutenant Hibbs that the City had not complied with the State regulations. She stated that she was unable to get any satisfaction, and then finally the State’s lawyer wrote the letter last week, indicating that the City already has a problem but if the renovation actions did not stop immediately – there was going to be a bigger problem. She then explained that finally they stopped work, but it still leaves her in a place to where she is not sure where to go from here. She related that it looks like Mr. Oakley responded favorably to the State’s lawyer and now her understanding is that the State has ordered a thorough asbestos inspection. She continued saying that since then Mr. Oakley has sent her some type of explanation regarding the types of asbestos, adding that her concern is that the carpet and ceiling tiles were taken out and disposed of, saying that even the explanation that Mr. Oakley gave her from the inspection company says that something could have been airborne. She stated that she is asking that when the thorough asbestos report gets back, that she can get some assistance as to where we are going from there and she is asking for airborne test. She stated that because the actual material that would have contained any type of asbestos was carried away before any testing was done. She stated that currently she is at a standstill as what to do, adding that she is genuinely concerned. She added that she was not feeling comfortable with how things were proceeding in this matter and felt it necessary to appear before the City Council and let them be aware of what is going on in her effort to seek assistance. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING FEBRUARY 6, 2020 6:00 P.M. – 6:49 P.M. Public Works Director Jim Oakley informed the City Council that they have already had a consulting firm come in that handles abatement and testing. He added that they had them in from the very beginning right after the first remediation done; and had the test. He then related that the test came back that anything they touched, the ceiling tiles and carpet, did not contain asbestos. He then informed the City Council that they have ordered further request of ADEQ a full asbestos survey, adding that once they get the test done and it shows the findings, an air test will be done at that time. He added that they will need to determine where best to do the test at and that will be done by the consultant and forwarded to ADEQ. Mayor Johnson stated that there is the Courtroom, which consists of the Chamber, restrooms, hallway and then the Courtroom and then the other side is the old Police Department that is really not being used. He then added that the back part which is the holding facility is being used. Public Works Director Jim Oakley stated that approximately 1/3 of the building is being used, adding that 2/3 is not in use or occupied. He stated that they plan to test the entire building, every aspect and every piece will be tested. He then added that they are having the air ducts cleaned by professional people regarding the mold. He then related that the carpets were cleaned by a mold expert. He stated that they spent about $14,000.00 to date; $4,000.00 in testing and the other $10,000.00 in cleanup. He stated that they got it sterilized and had the air scrubbed, which was all done in December. Judge Bailey stated that she had asked for the contractor’s report regarding that and they do not have it near to what you just stated. Public Works Director Jim Oakley stated that there was more done since the time she had asked for the report. Council Member Sipes asked Public Works Director Jim Oakley if he was involved in the asbestos test that was done years ago. Public Works Director Jim Oakley stated that he was not involved and he was not able to locate the results. Council Member Sipes related that there was no asbestos then. Mayor Johnson added not in the air. Public Works Director Jim Oakley stated that all tile in the 90’s has asbestos in it. He added that until they get the full test back they will not know every aspect. He stated that they are checking sheet rock in the old part that is not even being used, they checked the ceiling tiles this week, adding that it will be a thorough inspection. He then concurred with Council Member Traylor, that the inspection being done now meets ADEQ requirements. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING FEBRUARY 6, 2020 6:00 P.M. – 6:49 P.M. Mayor Johnson added that he feels it is really important to have the air quality test done. Judge Bailey stated that in terms of most of the building being used as storage, the front part is where the tile is that they are talking about, and the inspector has indicated that it probably needs to be dealt with because it is a high traffic area. She pointed out that is where everybody who comes in and out of the Courtroom walks. She stated that she included a picture in her handout showing where the tile has been cracked in the area where she walks. She noted that she had not seen that before the alleged renovations had taken place, which to her means that something was disturbed. She stated that she does have concerns that she feels are serious, adding that she is happy they are doing a thorough inspection but she wanted to clear up that the front part of the building is full of the tile that is indicated as red on the first limited inspection report. Public Works Director Jim Oakley then answered Council Member Traylor that they have not done any work there and as long as the tile is not disturbed it would not be an issue. He then answered Council Member Ray that it would take 4 days to get the results back from the lab. Council Member Ray stated that his concern is to make sure the employees are working in a safe environment. Public Works Director Jim Oakley answered that the test would be back next week. He added that following that the air test would be conducted and it should take about a week as well. Judge Bailey stated that in terms of the air test, she does feel as if something is there, because as late as today she got choked in the Courtroom. She added that she will say that she is super sensitive but she had something burn her eyes. She stated that there is something in there, adding that she is not sure if it is cleaning materials or what. She reiterated that she had an issue this afternoon and had not had that issue all day but when she got into the Courtroom she had an issue and before court was over she almost had to take a recess. She added that she feels very strongly that there is something going on, but is unaware of what. Council Member Bolden stated that he believes in long-range planning, so in the event that the air test comes back showing a problem, he would suggest that the City start working on a plan just in case and put it into place. Mayor Johnson stated that they have been looking at some alternatives already. He related that they have examined potentially other buildings, possibly using Police Department, and they have been talking to the school district about having them help remodel the building because eventually they will take over the building one day. He noted that in looking at other buildings they have to make sure the bathrooms are ADA compliant. He then stated that for now we need to make sure the Courtroom has good air and is totally safe. APPOINTMENTS: A&P COMMISSION Appointment of Council Member Collins to fill the unexpired term of former Council Member Elliott on the A&P Commission Council Member Ray moved, seconded by Council Member Bolden to approve the appointment of Council Member Collins to fill the unexpired term of former Council Member Elliott on the A&P Commission. MOTION CARRIED. Citizenry comment: Mr. Tommy Bond stated that he had submitted a letter to de-annex property commonly known as the “bean field” previously owned by the Dupree family. He stated that the new owners purchased the property that is west of Hwy. 67. They acquired the property for hunting purposes, which is their only intent. He explained that the only reason for de-annexation is to allow them to hunt. He related that he believes Council Member Collins has come up with an idea to create a new zone in the zoning that would allow hunting. He added that his clients are open to that idea and would withdraw their request for de-annexation based on being able to come up with a plan that would allow them to hunt. He then related that the new owners own approximately 700 acres, pretty much all the land with a couple of exceptions west of hwy. 67. He added that the property owners would like to participate in the development of that zoning ordinance if that is what will work best. In response to a question from Mayor Johnson, Council Member Collins agreed to form a committee to formulate a new zone allowing hunting. Council Member Ray and Sansing volunteered to serve on the committee. Mayor Johnson stated that the other thing that will be considered is if we can design a way to remove it and keep it from being an island but also protect it from the other boundaries. He stated that he and the City Council are open. Mr. Bond stated that the owners do not want to de-annex if they can use it for what they intended. Mayor Johnson stated that if it is easiest to de-annex it... He then added that most of the property is in the flood plain. He stated that all options would be discussed in committee. Mr. Bond stated that the County has some hunting and regulations where you can and can’t shoot; adding that they are willing to accept those stipulations. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING FEBRUARY 6, 2020 6:00 P.M. – 6:49 P.M. Mayor Johnson noted that one regulation is that you cannot shoot within 500 feet of major highway or structure. He then noted that we have not discussed yet that there is a study underway by ARDOT to do an east/west connector through there, which they already own the right-of-way at least to Oneida. He related that it would be a State Hwy. type of road, two lanes with shoulders. He stated that these are things we need to talk about. He then noted that it would include a bike trail. He then confirmed with Tommy Bond that the property is just short of Oneida. Mr. Don Ritchie of 1624 Pinion Lane stated that he has made complaints since Fletcher was Mayor, complained to Code Enforcement, his neighbor has a State code violation in his front yard. He added that he has tried to contact the City Attorney several times, because his understanding was that his neighbor would be served an abatement. He stated that nothing has been done. Mayor Johnson related that his landlord contacted him and his sister collected the rent, but nobody is collecting rent so he is not paying rent currently. Mr. Ritchie stated that if nothing is done he is going to his attorney to file a lawsuit. Mayor Johnson stated that he has talked with Code Enforcement and agrees it needs to be handled. Mr. Ritchie stated that rats are coming from the yard next door. Mayor Johnson asked that Captain Smith, himself and Mr. Ritchie have a meeting next week to discuss how to handle the situation. Mr. Jim Moore, President of the Stonewall Homeowners’ Association which has 497 homeowners, stated that he has provided photographs for the City Council, explaining that the photos were taken today around 2:30 p.m. when the City street sweeper was coming down east Martin turning onto south Stonewall Drive. He explained that the SUV has been parked in the road for two weeks. He related that he has sent emails to Code Enforcement. He explained that the City street sweeper barely missed the SUV because it is parked where it is interfering with the cleaning of the streets and the street sweeper had to cross the double yellow line to get pass the SUV. And, at the same time there was a car coming from the Senior Residences and towards the street sweeper, saying that this is an accident-prone situation to allow these vehicles to park on the streets. He added that he is aware that the City ordinance was changed approximately two or three months ago, adding that he receives a lot of phone calls and emails from the residents of Stonewall who are tired of seeing this. He then related that this is not the only SUV that parks on the street. He noted that the other houses may have several families living there and the vehicle stays parked on the street along with several cars parked in the driveway. He then related that he has spoken with Council Member Bolden regarding this situation. He stated that something needs to be done about this. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING FEBRUARY 6, 2020 6:00 P.M. – 6:49 P.M. Mayor Johnson recalled that when the ordinance was changed he believes it doesn’t allow for the parking of vehicles during the day, while the City is sweeping the streets or collecting the garbage and trash. He confirmed with Council Member Smith that she headed the committee that amended the parking ordinance. City Attorney Friedman stated that the ordinance states that you cannot block sanitation trucks, adding that street sweepers were not discussed. She noted that under the current Code this would not be a violation. Council Member Bolden offered that it could state City vehicles. City Attorney Friedman concurred, saying that it could be amended. Council Member Bolden questioned that if a vehicle has been parked for two weeks and Code Enforcement has been called why doesn’t that vehicle get ticketed. City Attorney Friedman stated that there is not a time fame in the current Code. Mayor Johnson stated that the vehicle must have license and be operable. He stated that would not be a Code violation but maybe it should be amended to be a violation. Mr. Moore stated that he feels the Code needs to be adjusted to take in some other considerations. He offered to serve on a committee to look at those considerations because this is happening all over Jacksonville. He pointed out Sunnyside Addition, saying that since the ordinance was passed there are more vehicles parking on the streets and blocking traffic. Council Member Bolden stated that the streets in Sunnyside are very narrow, making Sunnyside a different situation. He stated that this needs to be taken into consideration. He then pointed out that Stonewall has wider streets and much more flexibility, adding that there is really no need to park on the streets. Mayor Johnson stated that the design behind the ordinance was to not have vehicles parking in the front yard and making mud pits. He suggested that it might need to be reevaluated. Council Member Bolden stated that he would be willing to deal with that issue on the committee. He asked that Jim Moore be a member of the committee. Mayor Johnson conferred with Council Member Smith who agreed to head the committee regarding parking on City streets. Council Member Sipes stated that he served on the original committee and would be willing to serve again. He then reminded Jim Moore to bring in the POA rules. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING FEBRUARY 6, 2020 6:00 P.M. – 6:49 P.M. UNFINISHED BUSINESS: NEW BUSINESS: ANNOUNCEMENTS: Mayor Johnson announced that the Taste of New Orleans would be held February 20th at the Community Center. Tickets are $20.00. He then announced that the Father/Daughter Banquet would be February 22nd at the Community Center, which is a big event for Jacksonville. He explained that the event is open to all ages. It was noted that this is the 10th year for the event that is sponsored by the Sertoma Club. Municipal League Winter Conference will be held next week, beginning on Wednesday and going through Friday. The 5-K Cupid Dash will be held this Saturday. Mayor Johnson noted that there are approximately 100 people signed up for the event and 150 is expected. Discussion ensued as to hosting the Stonewall Bike Lane Committee alongside the City Parking Committee. Council Member Bolden confirmed that they would meet at 6:00 on Tuesday, February 11th for both Committee issues.
