ORDINANCE NO. 1630 (#04 - 20)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE OF
SPECIFIC COMPUTER SOFTWARE FOR THE FIRE DEPARTMENT; FOR
APPROPRIATE TRAINING AND ACCESS FOR DEPARTMENT
REPRESENTATIVES; DECLARING AN EMERGENCY; AND, FOR OTHER
PURPOSES.
WHEREAS, in 2014, the City Council of the City of Jacksonville passed Ordinance
1513 to waive the bidding for Jacksonville Fire Department's purchase of software services
for incident reporting, provided by ESO Solutions, Inc. of Austin, Texas. Additionally,
Jacksonville Fire Department also concurrently utilized FireHouse Software system for other
services.
WHEREAS, ESO Solutions, Inc. purchased Firehouse Software in 2020. As a result,
ESO Solutions, Inc. is now providing Jacksonville Fire Department with all but one software
platform service previously provided by Firehouse Software. Consequently, the Department's
fees for ESO Solutions, Inc. costs have increased, and fees to Firehouse Software have been
reduced.
WHEREAS, the Fire Department recommends waiver of competitive bidding and
request that it be allowed to continue to contract with ESO Solutions, Inc. for said services
and systems for the necessary software, support, training, and warranties.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE. Competitive bidding for the renewal of Fire
Department Emergency Services reporting software system, insurance, support, training, and
warranties for the Jacksonville Fire Department would be costly and non-productive, making
said competitive bidding unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived, pursuant to
ACA §14-58-383, to authorize contracting for a Fire Department Emergency Services
reporting system, related support, and training. Authorization is hereby given to the Fire
Chief to enter into contract with ESO Solutions, Inc. of Austin, Texas for the software
portion of the needed computer software, together with related support services and training,
all for a cost not to exceed Thirty-three Thousand and Nine Hundred Seventy-nine and
81/100 Dollars ($33,979.81), in addition to any applicable tax and associated fees.
SECTION THREE: All Ordinances, parts of Ordinances, or previous
actions taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTIONFOUR: This Ordinance, necessary for the improvement of
public services and for the benefit, health, safety, and welfare of the citizens of Jacksonville,
should be implemented immediately. Therefore, an emergency is hereby declared, and this
Ordinance shall be in force and effect from and after its date of passage.
