ORDINANCE NO. 1649 (#23-2020)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THE PURPOSE OF PURCHASING NEW
RADIO EQUIPMENT AND ACCESSORIES FOR JACKSONVILLE FIRE,
DISPATCH, AND POLICE DEPARTMENTS; DECLARING AN EMERGENCY;
AND, FOR OTHER PURPOSES.
WHEREAS, the City has determined that updated radio equipment and accessories
for Jacksonville Fire, Dispatch, and Police Departments are needed and can be provided by
Smith Two -Way Radio Inc.
WHEREAS, said equipment is not currently supported, as a result, City
recommends the waiving of competitive bidding and requests authority to contract with
Smith Two -Way Radio Inc. for radio equipment and accessories needed for Jacksonville
Fire, Dispatch, and Police Departments.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR
THE CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: Competitive bidding for updated radio equipment and
accessories for Jacksonville Fire, Dispatch, and Police Departments would be costly, non-
productive, and time consuming, making said competitive bidding unfeasible and
impractical.
SECTION TWO: Pursuant to Ark. Code Ann. §14-53-303, competitive
bidding is hereby waived for the purposed of purchasing radio equipment and accessories
for Jacksonville Fire, Dispatch, and Police Departments. Authorization is hereby given to
the Mayor and/or his authorized representative(s) to enter into contract with Smith Two -
Way Radio Inc. for said equipment. It is anticipated that the equipment and accessories,
together with all applicable taxes, shipping, and other associated costs due, as specified on
the attached, will be provided for the City of Jacksonville Fire Department at One Hundred
Forty Thousand Thirty-one Dollars and Sixty -Seven Cents ($140,031.67); Jacksonville
Dispatch at Nineteen Thousand Five Hundred Thirty-three Dollars and Ninety-two Cents
($19,533.92); and Jacksonville Police Department at One Hundred Eighty-six Thousand
Fourteen Dollars and Twenty-two Cents ($186,014.22).
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION FOUR: This Ordinance, necessary for the continued efficient
delivery of public services and for the benefit, health, safety, and welfare of the citizens of

_ Jacksonville, should be implemented immediately. Therefore, an emergency is hereby
declared, and this Ordinance shall be in force and effect from and after its date of passage.
