ORDINANCE NO. 1647 (#21-2020)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THE PURPOSE OF AN EMERGENCY
DRAINAGE REHABILITATION PROJECT ON HILL STREET; AND, FOR
OTHER PURPOSES.
WHEREAS, the Hill Street Drainage Rehabilitation Project will restore damaged
drainage areas necessary for maintaining the safety of the community; and
WHEREAS, to do so, it is necessary to obtain rentals and equipment from Jeff
Smith Farms, Inc. of Ward, Arkansas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR
THE CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of emergency drainage
rehabilitation of Hill Street would be costly, non-productive, and time consuming, making
said competitive bidding unfeasible and impractical.
SECTION TWO: Pursuant to Ark. Code Ann. §14-53-303, competitive
bidding is hereby waived for the purpose of two (2) track hoe rentals with operator, along
with equipment pick up and return. It is anticipated that the equipment rental and services,
as specified on the attached, will be provided for a total cost to the City of Jacksonville not
to exceed Thirty-five Thousand One Hundred Twenty Dollars ($35,120.00), together with
all applicable taxes and other associated costs due.
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION FOUR: This Ordinance shall take effect upon passage and
publication, as provided by and subject to the requirements of applicable law.
