1612ORDINANCE NO. 1612 (#19 - 20I9)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE
OF SPECIFIC TURNOUT GEAR FOR THE FIRE DEPARTMENT OF
JACKSONVILLE; DECLARING AN EMERGENCY; AND, FOR OTHER
PURPOSES.
WHEREAS, the Fire Department has found that twenty (20) Jacksonville
Firefighters have expired turnout gear which is no longer in compliance with
National Fire Protection Association (NFPA) standards, creating a safety violation;
and,
WHEREAS, said necessary turnout gear can be provided at a competitive
price through use of the David's Fire Equipment of Cabot, Arkansas. David's Fire
Equipment is a reliable source for said turnout gear and has agreed to furnish such
gear at a lower rate than the Department's current vendor. As such, the Fire
Department recommends waiver of competitive bidding and request that it be
allowed to contract with David's Fire Equipment for said turnout gear.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THA T.-
SECTION ONE; Competitive bidding for the purchase of a new
turnout gear for the Jacksonville Fire Department would result in a delay that would
be detrimental to the best interests of the Fire Department and the City.
SECTION TWO: Competitive bidding is hereby waived, pursuant to
ACA §14-47-183, to authorize contracting for Fire Department turnout gear.
Authorization is hereby given to the Fire Chief to enter into contract with David's
Fire Equipment of Cabot, Arkansas for a cost not to exceed Thirty-three Thousand
Five Hundred Fifteen and 00/100 Dollars ($33,515.00), together with any applicable
tax.
SECTION THREE; All Ordinances, parts of Ordinances, or previous
actions taken by said Council in conflict herewith are hereby repealed to the extent
of such conflict.

SECTION FOUR; This Ordinance, necessary for the improvement of
public services and for the benefit, health, safety, and welfare of the citizens of
Jacksonville, should be implemented immediately. Therefore, an emergency is
hereby declared, and this Ordinance shall be in force and effect from and after its
date of passage.
