1445 ORDINANCE NO, 1445 (#07 - 12)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THE PURCHASE AND UPGRADE
THROUGH PROPRIETARY SOFTWARE OF OUR HUMAN RESOURCES
DEPARTMENT, WHICH WILL COORDINATE WITH THE RECENTLY
PURCHASED SOFTWARE FOR THE FINANCE DEPARTMENT; AND, FOR
OTHER PURPOSES.
WHEREAS, the Finance Department recently purchased new proprietary
software for maintenance and upgrade of the City's financial records in compliance
with current CAFR standards;
WHEREAS, the Jacksonville Human Resources Department has the
opportunity to purchase compatible proprietary software that will not only provide
improved payroll processing and record keeping for the Human Resources
Department but will also provide reports, attendance logs, databanks, and federal
compliance reports required of our Human Resources Department in an improved
and more efficient manner. The software will also coordinate and allow seamless
exchange of employee and payroll information between Human Resources and our
Finance Department. Having this software available will minimize required data
entry, work duties, and substantially improve record keeping and reporting for both
Departments, which will be an additional cost savings; and,
WHEREAS, in doing so, the City can save monies by purchasing the Human
Resources software at this time to allow installation, implementation, and training of
the two system upgrades (Finance and HR) simultaneously. Because the software is
proprietary, it can only be obtained from one source, BS&A Software, of Bath,
Michigan.
BE IT ORDAINED A N D ENACTED BY THE CITY COUNCIL O F THE CITY
OF JACKSONVILLE, ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of obtaining
program and proprietary software for the Jacksonville Human Resources
Department would be costly non-productive, and time consuming, making said
competitive bidding unfeasible and impractical.
SECTION TWO; Pursuant to ACA § 14-58-383, competitive bidding is
hereby waived for the purpose of purchasing proprietary software for compatible
proprietary software, its installation, and initial implementation of said system for
the Human Resources Department. Authorization is hereby given to the Mayor
and/or his designated representative to execute necessary documents with BS&A
Software, of Bath, Michigan, the only supplier of said proprietary software and
services, for said purchase. It is anticipated that the software and services, as
specified on the attached, will be provided for a total cost to the City of Jacksonville
not to exceed Fifty-nine Thousand Two Hundred Six and 50/100 Dollars
($59,206.50), together with any applicable taxes and other associated costs due.

SECTION THREE: All Ordinances, parts of Ordinances,or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION FOUR; This Ordinance shall take effect upon passage and
publication, as provided by and subject to the requirements of applicable law.
