0677 RESOLUTION NO. 677 (#03 - 12)
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK OF THE
CITY OF JACKSONVILLE, ARKANSAS, TO EXECUTE ALL
APPROPRIATE DOCUMENTS FOR THE EXCHANGE AND TRANSFER
OF CERTAIN REAL PROPERTY; AND, FOR OTHER PURPOSES.
WHEREAS, the potential development of public park services in
the Sunnyside Addition of the City in recent years has resulted in a need
and use of certain real property owned by others in certain locations in
and about Sunnyside Addition;
WHEREAS, through the generosity of City employee Kevin B. Cole
and his wife, Tammy, it is possible for the City to acquire a particular lot
needed for future public facilities through exchange of a lot the City owns
that will not be needed for future public facilities development; and,
WHEREAS, in accordance with State law and the values of said
properties, the Jacksonville City Council must approve the exchange of
said real property between the parties.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The Mayor and City Clerk are hereby
authorized to execute the necessary documentation on behalf of the City
of Jacksonville, Arkansas, for disposition and exchange of the real
property described below owned by the City of Jacksonville and Kevin B.
and Tammy Cole. The properties to be transferred are more fully
described as follows:
TRACT 1:
CITY OF JACKSONVILLE, ARKANSAS
Lot 56, Block 0, Sunnyside Hills Addition to the City of
Jacksonville, Pulaski County, Arkansas.
**Property a/k/a 118 Jaxon, Jacksonville, AR 72076**
Pulaski County Parcel No. 12J-069.00-059.00
TRACT 2:
KEVIN B. COLE
Lot 167 except the East 17 feet, Block 0, Sunnyside Hills Addition
to the City of Jacksonville, Pulaski County, Arkansas.

SECTION TWO: The documentation executed to transfer
said properties will provide appropriate limitations regarding potential
future uses and provisions for relevant issues regarding the property
transfer in order to satisfy all local, state, and federal directives,
guidelines, and requirements.
SECTION THREE: Any and all other Resolutions in
conflict herewith are hereby repealed to the extent of said conflict. This
Resolution shall be in effect from and after its date of passage.
