0675 RESOLUTION NO, 675 ( #01- 2012) A RESOLUTION AUTHORIZING AND DECLARING A MORATORIUM UPON APPROVAL AND ISSUANCE OF BILLBOARD PERMIT(S) WITHIN THE CITY OF JACKSONVILLE, ARKANSAS, FOR A MINIMUM PERIOD OF SIX (6) MONTHS OR UNTIL THE ARKANSAS HIGHWAY DEPARTMENT FINALIZES PLANS FOR MODIFICATIONS TO HWY; 67/167; PROVIDING FOR CERTAIN OTHER MATTERS RELATING THERETO; DECLARING AN EMERGENCY, AND, FOR OTHER PURPOSES. WHEREAS, the City of Jacksonville has a number of billboard placements along the major thoroughfares within the City, particularly with consideration of such locations throughout the North business corridor. However, preliminary plans from the Arkansas Highway Department indicate modifications to the routing and traffic patterns of the State's major thoroughfares through Jacksonville. As a result, billboard placement within the City, particularly along State thoroughfares, could create problems and unnecessary expenses for the City and potential billboard owners and users alike; and, WHEREAS, it is important to develop and have detailed plans and a full review of such, with appropriate public input, to insure future billboard placements throughout the City are appropriate, long -term in nature, and beneficial for both citizens and our business community alike. As a result, City officials, including the Jacksonville Planning Commission, hereby request a moratorium on approval of billboard permits until the expiration of Six (6) months or until the Arkansas Highway Department provides more definitive plans as to proposed changes to the traffic and thoroughfare patterns through Jacksonville and City officials then have sufficient time to analyze and adequately address the issue of appropriate billboard placements within the City of Jacksonville. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: A moratorium is declared for a minimum period of Six (6) months or until the Arkansas Highway Department provides definitive plans as to proposed changes to the traffic and thoroughfare patterns through Jacksonville city limits and City officials then have sufficient time to analyze and adequately address appropriate billboard placement(s) within the City of Jacksonville. The Council does so to allow for development of definitive plans for any modifications to traffic and thoroughfare patterns through the City of Jacksonville so as to avoid and prevent inappropriate and /or temporary placement of billboards in conflict with said plans and modifications. The Council believes that doing so is conducive to good planning for continued organized development and growth of Jacksonville along the State's major thoroughfares that run through our City limits. Resolution No. 675 ( #01 -2012) Page Two SECTION TWO: The Mayor of the City of Jacksonville, Arkansas, is authorized to execute such writings and take such actions as may be appropriate to carry out the terms of this Resolution. Action heretofore taken by the Mayor and consistent with the purposes of this Resolution is hereby ratified and approved. SECTION THREE: It has hereby been found that a moratorium on approval of billboard permits is plainly in the interest of the City and that passage of this Resolution is essential to the proper development of areas of the City through which major State thoroughfares traverse. Therefore, it is hereby declared that an emergency exists and this Resolution, being necessary for the immediate preservation of the public health and safety, shall take effect and be enforced from and after its adoption. SECTION FOUR: Any and all other Resolutions in conflict herewith are hereby repealed to the extent of said conflict. This Resolution shall be in effect from and after its date of passage.
