ORDINANCE NO. 1164 (#18 . 01)
AN ORDINANCE CONDEMNING THE STRUCTURES AND REAL PROPERTY AT
THE VARIOUS UNINHABITED LOCATIONS LISTED BELOW LOCATED WITHIN
JACKSONVILLEK~RKANSA~ FOR STRUCTURAL DEFECTS,1.,CODE VIOLATIONS
AND PUBLIC HALARD CONuITIONS; DECLARING AN EME~GENCY; AND, FOR
OTHER PURPOSES.

WHEREAS, the uninhabited structure and real property at the following street address,
located within the City limits of Jacksonville, owned by the various parties as cited below, constitute
a health and safety hazard to the general public due to the lack of structural soundness and
dilapidated conditions which exist in the various improvements thereon. The property and owners
involved are as follows:

The property is more particularly described as follows:
lot 172, Sunnyside Hills Addition to the City of Jacksonville, Pulaski County, Arkansas.
WHEREAS, despite extensive notice and demand, said property owners have not repaired
their property, structure, and/or removed the deteriorated elements so as to eliminate the public health
and safety hazards and bring the property and its improvements into compliance with the provisions
of the Jacksonville Municipal Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF
JACKSONVillE, ARKANSAS:
SECTION ONE: In accordance with ACA ~14-56-201 et. al. and Jacksonville Municipal Code
~8.28.010 et. seq., the above mentioned structures and real properties (located at 105 West Avenue
and 117 Joiner Street), are hereby declared to each constitute a nuisance to the health and safety of
the citizens of Jacksonville.
The City Council hereby directs the Code Enforcement Office to provide notice to the property
owners and all other interested parties (as cited above) that, if said structure and real property are not
repaired and/or the health and safety hazards removed from said structure, bringing it back into
compliance with the provisions of the Jacksonville Municipal Code, within thirty (30) days from the date
of passage of the Ordinance, the structure and improvements on said real property cited above will
be cleared and razed. All structures and nuisances shall be removed so as to eliminate any health
or safety hazards to the general public, and the cost for doing so shall be assessed against the
owner(s) of said property.
SECTON TWO: If the City of Jacksonville is required to undertake and/or complete removal
of hazardous conditions from the real property in question, the City will then file a tax lien against the
respective real property involved for collection of all reasonable costs incurred to undertake and
complete the removal of said hazardous conditions on that property and authorize City officials to
request said amounts be collected by the Pulaski County Tax collector should the owners fail to timely
pay said fees and amounts due.

SECTION THREE: Should any part(s) of this Ordinance be declared invalid for any reason,
no other part(s) of the Ordinance shall be affected by said declaration.
SECTION FOUR: All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION FIVE: This Ordinance is necessary for the public health, safety, and welfare of the
public. Because of such, an emergency is hereby declared, and this Ordinance shall be in effect from
and after its date of passage. (
