REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE
The City Council of the City of Jacksonville, Arkansas met in Regular
Session on July 7, 2011 at the regular meeting place of the Council.
Alderman Smith delivered the invocation and Charles Jenkins of Scout
Troop 170 led a standing audience in the “Pledge of Allegiance” to the
flag.
ROLL CALL: Aldermen: Elliott, Smith, McCleary, Ray, Rinker, Traylor,
Stroud, Robinson, and Howard answered roll call. Mayor Fletcher also
answered ROLL CALL declaring a quorum. Alderman Sansing arrived at
approximately 7:04. PRESENT TEN (10), ABSENT (0).
Others present for the meeting were: City Attorney Robert Bamburg,
Director of Administration Jim Durham, Fire Chief John Vanderhoof, Police
Chief Gary Sipes, Finance Director Cheryl Erkel, 911 Director Tabby
Hughes, City Engineer Jay Whisker, Public Works Director Jim Oakley,
Human Resource Director Jill Ross, CDBG Director Theresa Watson, IT
Director Barbara Daniel, Glenda Fletcher, Addie Gibson, Jim Moore,
interested citizens, and members of the press.
PRESENTATION OF MINUTES:
Mayor Fletcher presented the minutes of the special City Council meeting
of June 14, 2011 for approval and/or correction at the next regularly
scheduled City Council meeting.
APPROVAL AND/OR CORRECTION OF MINUTES:
Alderman Stroud moved, seconded by Alderman Smith that the minutes of the
Regular City Council meeting of 2 June 2011 be APPROVED. MOTION CARRIED.
CONSENT AGENDA: REGULAR MONTHLY REPORT/ANIMAL CONTROL
Alderman Ray moved, seconded by Alderman Stroud to approve the Regular
Monthly Animal Control Report for June 2011. Said report reflects:

STREET DEPARTMENT: RESOLUTION 663 (#9-2011)
A RESOLUTION EXPRESSING WILLINGNESS OF THE CITY OF JACKSONVILLE TO
UTILIZE FEDERAL-AID ENHANCEMENT FOR THE MARSHALL ROAD SIDEWALK
IMPROVEMENT PROJECT, PHASE I; AND, FOR OTHER PURPOSES.
Public Works Director Jim Oakley related that the City applied for the
enhancement grant last year to construct a sidewalk on Marshall Road. He
stated that the initial request was to construct sidewalks on both sides,
explaining that there is partial sidewalk on both sides, adding that the
goal is to have the sidewalk go up to Vandenberg. He stated that the
cost estimates came in around $220,000.00, adding that the project was
received $100,000 in funding. He then related that the grant is an 80/20
match grant, adding that the match is in the City sidewalk fund. He
stated that City is fortunate to receive this grant. He answered that
that original request was for funding to construct sidewalk on both sides
of Marshall Road, but the grant came in at half the amount of funding.
He explained that the City is going to complete construct sidewalk on one
side this year. He added that the City will then request adding funding
in the future.
Alderman Smith moved, seconded by Alderman Stroud to read Resolution 663
(#9-2011). MOTION CARRIED.

GENERAL: 7:05 p.m. PUBLIC HEARING
a. ORDINANCE 1421 (#9-2011)
AN ORDINANCE AMENDING JACKSONVILLE MUNICIPAL ORDINANCE NOS. 213 AND 238;
RENAMING A PORTION OF WALNUT STREET TO ALLEN LANE; FOR PROPERTY USE
PROVISIONS AND DESIGNATIONS; AND, FOR OTHER PURPOSES.
Mayor Fletcher opened the public hearing at approximately 7:05 p.m.
Assistant Pastor of Immanuel Family Worship Center, Lou Turner spoke in
favor of the street renaming. She related that the members of Immanuel
Family Worship Center, established 21 years ago, are making this request
to honor their founding pastor, Mr. Ricky Allen. She explained that the
portion of Walnut Street that is being proposed for renaming runs along
the Church’s property. She then related that there is only on residence
on that street. She noted the civic works of Pastor Allen, and his
endeavors to lead his congregation to be supportive of the Boys Club, the
Jacksonville Elementary School, and the Chamber of Commerce.
With no one to speak in opposition, Mayor Fletcher closed the public
hearing at approximately 7:06 p.m.
Alderman Elliott moved, seconded by Alderman Stroud that Ordinance 1421
be placed on FIRST READING. ROLL CALL: Aldermen Elliott, Smith,
McCleary, Sansing, Ray, Rinker, Traylor, Stroud, Robinson, and Howard
voted AYE. NAY (0). MOTION CARRIED. Whereupon City Attorney Bamburg
read the heading of Ordinance 1421.
Alderman Stroud moved, seconded by Alderman Ray that Ordinance 1421 be
APPROVED on FIRST READING and to suspend the rules and place on SECOND
READING. ROLL CALL: Aldermen Elliott, Smith, McCleary, Ray, Rinker,
Traylor, Stroud, Robinson, and Howard voted AYE. NAY (0). ABSTAIN (1).
Alderman Sansing abstained. MOTION CARRIED. Whereupon City Attorney
Bamburg read the heading of Ordinance 1421.

rules and place Ordinance 1421 on THIRD and FINAL READING. ROLL CALL:
Aldermen Elliott, McCleary, Ray, Rinker, Traylor, Stroud, Robinson, and
Howard voted AYE. NAY (0). ABSTAIN (1). Alderman Sansing abstained.
MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of

b. Discussion to create a Fireworks Committee
Mayor Fletcher related that fireworks have been a topic lately for many
cities, noting that the 911 call system was inundated with calls over the

July 4 holiday. He stated that those calls pulled police officers off
the street from their regular duties, shifting the focus from more
serious issues. He questioned if a window to allow the shooting of
fireworks would be the answer or should the City continue to ban the
shooting of fireworks. He stated that it has become a growing problem
for all communities, noting that 911 received 117 calls. He then
answered that he is not aware of any injuries in Jacksonville as a result
of fireworks.
Alderman Sansing noted that the 117 fireworks calls were regarding the
fact that the shooting was disturbing the peace. He went on to say that a
lot of times it is kids shooting fireworks all over the neighborhood and
disturbing the peace.
Alderman Stroud stated that it’s better to not have a law then to have a
law and not enforce it. He related that it is impossible to completely
stop kids from shooting fireworks. He supported the creation of a
committee, suggesting that there be an allowable time to shoot fireworks
that will not interfere will sleep hours. He added that if fireworks are
discharged outside the allowable hours then the law needs to be enforced
strictly with citations and fines.
Mayor Fletcher concurred, saying that he feels there would be better
control if you offer a period of allowance.
Alderman Howard noted that Little Rock offered a separate telephone
number from the 911 number that residents could call regarding fireworks.
Mayor Fletcher related that the problem is the manpower it takes to
handle each call, explaining that with the recent annexation the City has
now increased to eight zoning patrols. He then related that some areas
received repeated calls that the police had to respond to. He stated
that while he does not care for or like fireworks being discharged in the
neighbors, it is impossible to completely stop kids from shooting
fireworks.
Alderman Stroud moved, seconded by Alderman Smith to create a fireworks
committee to investigate controlling the situation. MOTION CARRIED.
Aldermen McCleary, Stroud, Robinson and Ray offered to serve on the
committee. Alderman Ray offered to Chair. The citizen who offered to
serve is Jerry Bryan.

UPDATE ON COMMUNITY CENTER SWIMMING POOL
Mayor Fletcher related that currently everything is waiting on the
engineer, saying that there is a possibility that the underneath iron
structure can be saved.
Director of Administration Jim Durham related that he learned that the
engineer is waiting on drawings. He then stated that he has requested a
set of drawings that would match the building, noting that the current
drawings and specifications do not even closely resemble what was
actually constructed. He related that the engineer is determining the
web thickness and specifications as built, so he can make a determination
as to whether the deterioration of the structure is such that it would
have to be replaced.
Mayor Fletcher noted that unfortunately it will be a long and expensive
process.
