ORDINANCE NO. 1401 (#06 - 10)
.4N ORDINANCE WAIVING CO MPE TI TI VE BIDDING FO R THE PURPOSE O F
PURCHASING 15" -18 "PIPE BURST HDPE AND INSTALLATION FOR USE
BY THE JACKSONVILLE WASTEWATER UTILITY; DECLARING AN
EMERGENCY; AND, FOR OTHER PURPOSES.
WHEREAS Heller Company, Inc. of Hot Springs, Arkansas, won the annual
bid with the Jac Wastewater Utility for certain sewer rehabilitation and
construction projects within the City of Jacksonville; and,
WHEREAS, a particular rehabilitation project along Loop Road requires use
and installation of 15" - 18" Pipe Bursting HDPE. Because Heller Company, Inc.,
won the bidding for the remaining project requirements and has such piping readily
available at a competitive price, the Jacksonville Wastewater Utility recommends
waiver of competitive bidding and requests that it be allowed to contract with Helier
Company, Inc. for purchase of said piping.
NOW THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY

COUNCIL F THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the purchase and installation of
15' - 18" HDPE Piping Bursting material for the Jacksonville Wastewater Utility would
be costly and non - productive, making said competitive bidding unfeasible and
impractical.
SECTION TWO: Competitive bidding is hereby waived, pursuant to ACA
§14-58-383, to authorize purchase and the installation of the required piping.
Authorization is hereby given to the Jacksonville Wastewater Utility to enter Into an
Addendum to Contract (i.e., Change Order) with Heller Company, Inc. of Hot
Springs, Arkansas forpurchase and installation of sufficient quantity approximately
312 linear feet) of 15 18" HDPE Pipe Bursting, all for a cost not to exceed Eighty
Thousand Five Hundred Thirty and 32/100 Dollars ($80,530.32), together with any
applicable tax.
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION FOUR: This Ordinance, necessary for the improvement of public
facilities and the health, safety, and welfare of the citizens of Jacksonville, should be
implemented immediately. Therefore, an emergency is hereby declared, and this
Ordinance shall be in force and effect from and after its date of passage.
