1398 ORDINANCE NO, 1398 ( #3 - 10)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE
OF NEW PROTECTIVE SAFETY BOOTS AND AN ADDITIONAL ZOLL ACLS
MANUAL DEFIBRILLATOR AND AUTOPULSE SYSTEM, TOGETHER WITH
RELATED EQUIPMENT FOR THE JACKSONVILLE FIRE DEPARTMENT; AND,
FOR OTHER PURPOSES.
WHEREAS, the Jacksonville Fire Department is in need of new protective
safety boots to enhance our firefighters' safety equipment and protective clothing;
WHEREAS, Casco Industries, of Bryant, Arkansas, is the single source for
Globe protective clothing in Arkansas, the manufacturer which has provided all of
the Department's protective clothing equipment, and Casco has agreed, as before,
to furnish said protective boots at a competitive cost in an efficient manner. As
such, the Department requests and recommends waiver of competitive bidding for

the purchase of needed protective boots from Casco Industries;
WHEREAS, the Jacksonville Fire Department is also in need of a ZOLL ACLS
Manual Defibrillator and Autopulse System, together with the necessary related
equipment, to enhance and better equip the City's EMS ambulance service; and,
WHEREAS, ZOLL Medical Corporation is the only source for such a system
that is compatible with existing Department equipment, and ZOLL has agreed to
furnish such at a competitive cost in an efficient manner. As such, the Department
requests and recommends waiver of competitive bidding and to contract with ZOLL
Medical to purchase the needed Autopulse system and related equipment.
NOW THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the purchase of new protective
boots and a ZOLL ACLS Manual Defibrillator and Autopulse System and related
equipment for the Jacksonville Fire Department would be costly and non - productive,
making said competitive bidding unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived, pursuant to ACA
§14 -58 -383, to authorize the purchase of Fifty -nine (59) pairs of new Globe leather
protective structure boots to complete all Jacksonville firefighters' protective clothing
ensembles. Authorization is hereby given to the Mayor and City Clerk to enter into a
contract with Casco Industries, Bryant, Arkansas, for the purchase of said boots for
the Jacksonville Fire Department at a cost not to exceed Eighteen Thousand Five
Hundred Twenty -four and 30/100 Dollars ($18,524.30), together with any applicable
taxes and shipping costs.

SECTION THREE: Competitive bidding is hereby waived, pursuant to ACA
§14 -58 -383 to authorize the purchase of a ZOLL ACLS Manual Defibrillator and
Autopulse System and related equipment for the Jacksonville Fire Department.
Authorization is hereby given to the Mayor and City Clerk to enter into a contract
with ZOLL Medical Corporation, 269 Mill Road, Chelmsford, Massachusetts for the
purchase of said ZOLL ALCS Manual Defibrillator and Autopulse System and related
equipment for the Jacksonville Fire Department at a cost not to exceed Thirty-six
Thousand Seven Hundred Twenty-three and 80/100 Dollars ($36,723.80), together
with applicable tax.
SECTION FOUR: All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION FIVE: This Ordinance shall take effect immediately upon
passage and publication, as provided by and subject to the requirements of
applicable law.
