1390 ORDINANCE NO. 1390 ( #33 - 09) AN ORDINANCE AMENDING JACKSONVILLE MUNICIPAL CODE§ 9.50 TO IMPOSE ANADDITIONAL TWENTY -FIVE DOLLARS 025,00) FEE FOR ALL TRAFFIC AND CRIMINAL WARRANT(S) AND /OR ORDER(S) OF ARREST SERVED BY OR THROUGH THE JACKSONVILLE POLICE DEPARTMENT FROM ANY COURT OF PROPER JURISDICTION, INCLUDING THE JACKSONVILLE DISTRICT COURT; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. WHEREAS, the General Assembly of the State of Arkansas enacted §14 -52- 202, which allows a Police Chief to assess administrative fees and costs incurred in the operation and administration of law enforcement duties related to service of process of Traffic and Criminal Warrant(s) and /or Order(s) of Arrest; and, WHEREAS, the City of Jacksonville could benefit from additional revenues created by adoption of this Ordinance to cover the costs and additional expenses involved in serving Traffic and Criminal Warrant(s) and assist in defraying said costs. NOW, THEREFORE, BE IT ORDAINED B Y THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT ;; SECTION ONE: Pursuant to the authority granted by ACA tY9 Y § 14-52 - 202, as it relates to the fees and administration of such in ACA § 21 -6 -307, Jacksonville Municipal Code § 9.50 is hereby created and shall read as follows: JMC § 9.50 (Warrant Fee) shall read as follows: There shall be an assessment and collection of a Twenty-five Dollars ($25.00) warrant fee for each Warrant(s) and /or Order(s) of Arrest served by the Jacksonville Police Department issued from any Court of competent jurisdiction, including the Jacksonville District Court. Implementation of said fee shall begin for any such Warrant(s) and /or Order(s) of Arrest served on or after January 1, 2010. All fees collected for service of process of Warrants and Orders of Arrest by the Jacksonville Police Department shall be forwarded to the City Treasury for use and distribution as directed by the City Council in accordance with applicable law. SECTION TWO: All Ordinances or parts thereof in conflict herewith are hereby repealed to the extent of said conflict. SECTION THREE: This Ordinance, necessary for the improvement of public facilities and the health, safety, and welfare of the citizens of Jacksonville, should be implemented immediately. Therefore, an emergency is hereby declared, and this Ordinance shall be in force and effect from and after its date of passage. APPROVED AND ADOPTED THIS I 1 DAY OF DECEMBER, 2009.
