ORDINANCE NO. 1383 ( #26 - 09)
AN ORDINANCE WAIVING COMPETIITVE BIDDING FOR THE PURPOSE OF
CONTRACTING WITH RETAIL ATTRACTIONS, LLC, FOR ECONOMIC AND
RETAIL DEVELOPMENT SERVICES FOR THE CITY OF JACKSONVILLE;
DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES.
WHEREAS, it is the desire of the City of Jacksonville to attract, recruit, and
sales tax producing commercial business entities; and,
WHEREAS, Retail Attractions, LLC, of Owasso, Oklahoma, has agreed to
provide such services at a competitive price and in a timely manner. As such, the
City of Jacksonville recommends and requests waiver of competitive bidding so that
the City may enter into a contract with Retail Attractions, LLC.
NOW THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT ::
SECTION ONE; Competitive bidding to retain professional services for
economic and retail commercial business development for the City of Jacksonville
would be costly and non - productive, making said competitive bidding unfeasible and
impractical.
SECTION TWO: Competitive bidding is hereby waived, pursuant to ACA
§14 -58 -383, and authorization is hereby given to the Mayor and /or his authorized
agent to enter a contract with Rickey Hayes, Princippal, of Retail Attractions, LLC,
12150 East 96 Street North, Suite 202, Owasso, Oklahoma 74055, for the purpose
of retaining said firm for economic and retail commercial business development for
the City of Jacksonville at an annual cost not to exceed Sixty-two Thousand Dollars
($62,0), or peroverin O 10, 2 thog Oto October 1, 010.

SECTION THREE: All Ordinances parts of Ordinances or previous actions
of this Council in conflict herewith are hereby repealed to the extent of such conflict.
SECTION FOUR: This Ordinance, necessary for the improvement of public
services and the health, safety, and welfare of the citizens of Jacksonville, should be
implemented immediately. Therefore, an emergency is hereby declared, and this
Ordinance shall be in force and effect from and after its date of passage.
