AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE OF
PURCHASE AND INSTALLATION OF EMERGENCY COMMUNICATION
EQUIPMENT FOR THE CITY OF JACKSONVILLE'S 911 COMMUNICATION
CENTER; AND, FOR OTHER PURPOSES,
WHEREAS, Jacksonville 911 Communication Center has received a partial
grant award to refurbish, purchase, and install new and modified emergency digital
communication equipment so that Jacksonville will be included in the developing
Statewide Emergency Communication System all of which will be installed and
utilized by Jacksonville's new 911 Emergency Communication Center; and,
WHEREAS, a particular company, Motorola, is the approved provider for the
Statewide Emergency Communication System equipment. As such, the grant
monies and inclusion of the City in the Statewide system mandates that the City
utilize Motorola as the equipment provider so as to be completely compatible with
the Statewide system. As well, Motorola, as supported by Grace Communications,
has agreed to provide such upgraded equipment, installation, and support at a
competitive amount and with a payment method acceptable to the City of
Jacksonville. As a result, solicitation of and publication for competitive bidding
would be of no assistance and would actually delay the acquisition of the needed
upgrades and improvements for the City's emergency communication system.
NOW THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding to upgrade, purchase, and
install Motorola emergency digital communication equipment and facilities at the
Jacksonville 911 Communications Center would be costly and non - productive,
making said competitive bidding unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived, pursuant to
ACA §14 -58 -383, to upgrade, purchase, and install Motorola emergency digital
communication equipment and facilities at the Jacksonville 911 Communications
Center. Motorola, both the company and its support services by and through Grace
Communications of North Little Rock, Arkansas, is hereby authorized to order,
install, and manufacture the necessary upgrade purchase, and install Motorola
emergency digital communication equipment and facilities at the Jacksonville 911
Communications Center, all for a cost not to exceed Two Million Four Hundred
Ninety -seven Thousand Five Hundred Twenty-six and 40/100 Dollars
($2,497,526.40), together with any applicable taxes and fees.

SECTION THREE: In addition, the Mayor and /or his authorized
agent, representative, or designee, is granted the authority to negotiate and
execute any and all necessary documents and instruments to implement and secure
the terms of the parties' agreements in compliance with the terms of this Ordinance,
State law, and Federal law.
SECTION FOUR: All Ordinances, parts of Ordinances, or previous
actions taken by said Council in conflict herewith are hereby repealed to the extent
of such conflict.
SECTION FIVE; This Ordinance, necessary for the improvement of
public emergency digital communication equipment and facilities, safety, and
welfare of the citizens of Jacksonville, should be implemented as soon as possible.
Therefore, this Ordinance shall be in force and effect from and after its date of
passage, subject to and in compliance with applicable law.
