ORDINANCE NO, 1361 (#4 - 09)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THE PURPOSE OF PURCHASING NEW
FIRE PROTECTIVE GEAR (TURNOUTS) FOR THE JACKSONVILLE FIRE
DEPARTMENT; D ECL A R I NG A N EMERGENCY; AND, A D R OTHER PURPOSES.
WHEREAS, the Jacksonville Fire Department has need of additional fire
protective gear (turnouts) for new employees and to replace aging protective gear;
and,
WHEREAS, the Jacksonville Fire Department has, for several years, searched
unsuccessfully for additional suppliers of such gear. However, the Department
believes that, after such a search, Casco Industries, Inc. of Bryant, Arkansas, is the
best and sole supplier for the current and future needs of the Department, for Casco
provides such at a fair and reasonable price with adequate supplies to timely meet
the needs of the Department.
NOW THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL 6F THE CITY 6F JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the purpose of purchase of new
fire protective gear (turnouts) for the Jacksonville Fire Department would be costly,
non - productive, and time consuming, making said competitive bidding unfeasible
and impractical.
SECTION TWO: Pursuant to ACA §14 -58 -383, competitive bidding is
hereby waived for the purpose of purchasing fire protective gear (turnouts) for the
Jacksonville Fire Department. Authorization is hereby given to the Mayor and /or his
designated representative to execute necessary documents with Casco Industries,
Inc. of Shreveport, Louisiana, for the purchase of said protective gear. It is
anticipated that the gear, as specified will be provided for a total cost not to exceed
Sixty-five Thousand One Hundred Sixty-nine and 25/100 Dollars ($65,169.25),
together with applicable shipping and taxes.
- SECTION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION FOUR: To provide more effectively for the health, safety, and
comfort of our firefighters and citizens in the operation of our Fire Department's Fire
and Rescue Services, an emergency is hereby declared to exist. This Ordinance shall
take effect immediately upon passage and publication, as provided by and subject to
the requirements of applicable law.
