AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE OF
EQUIPMENT AND SERVICES REGARDING COPIER /PRINTER MAINTENANCE
SERVICES, COMPUTER SOFTWARE, SCANNERS, WEBLINKS, WEB PUBLISHING,
AND OTHER SUCH NECESSARY EQUIPMENT OR MAINTENANCE SERVICES FOR
USE BY THE CITY OF JACKSONVILLE; DECLARING API EMERGENCY; AND, FOR
OTHER PURPOSES,
WHEREAS, the City of Jacksonville is in need of updated software, scanners, Weblink
equipment, publishing, applicable services, and other computer software and related
services, equipment, and training; and,
WHEREAS, DATAMAX MICRO, as the City's current Value Added Retailer (VAR) of
copier /printer maintenance and support services, computer software for scanning and
related equipment, and Weblink services has the ability and offers to provide said needed
additional and upgraded equipment, services, software, and training at a competitive price.
As such, DATAMAX -MICRO agrees to furnish said copier /printer maintenance services,
Weblink module and web publishing services, and scanning software, equipment, and all
necessary training at a competitive cost and in a timely manner. As such, the City
recommends waiver of competitive bidding and request that it be allowed to contract with
DATAMAX -MICRO to purchase the needed upgrades, system requirements, and services.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL
OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the purchase of said copier /printer
maintenance services, computer software upgrades for scanning and related equipment,
Weblink module and web publishing services, and the necessary support and training
required for said computer services for the City of Jacksonville would be costly and non -
productive, making said competitive bidding unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived, pursuant to ACA §14-
58 -383, to authorize the purchase of copier /printer maintenance services, scanning
software, support services, and related equipment and training, and Weblink modules and
web publishing services, together with the necessary other computer equipment, services,
and training as required for the City of Jacksonville. Authorization is hereby given to the
Mayor and City Clerk to enter into a contract with DATAMAX - MICRO, of 7400 Kanis Road,
Little Rock, Arkansas, for the purchase of said maintenance and support services, software,
related equipment, and training at a cost not to exceed Eighty -six Thousand Five Hundred
Two Dollars ($86,502.00), together with any applicable tax.
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions in
conflict herewith are hereby repealed to the extent of such conflict.
SECTION FOUR: This Ordinance, necessary for the improvement of public
services and facilities of the citizens of Jacksonville, should be implemented immediately.
Therefore, an emergency is hereby declared, and this Ordinance shall be in force and effect
from and after its date of passage.
