1434 ORDINANCE NO. 1434 ( #22 - 2011) AN ORDINANCE FOR THE PURPOSE OF LEVYING AN ADDITIONAL TWENTY DOLLARS ($20.00) TO BE COLLECTED FROM ALL PERSON(S) FOUND GUILTY, PLEADING GUILTY, PLEADING NOLO CONTENDRE, OR WHOM FORFEIT BOND(S) FOR ANY AND ALL TRAFFIC AND MISDEMEANOR OFFENSE(S) WITHIN THE DISTRICT COURT OF THE CITY OF JACKSONVILLE, ARKANSAS, WITH SAID FUNDS MAINTAINED SEPARATELY TO DEFRAY COSTS OF OPERATIONS, MAINTENANCE, AND /OR CAPITAL EXPENDITURES FOR THE CITY'S DETENTION FACILITIES AND COSTS OF INCARCERATION OF CITY PRISONERS; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. WHEREAS, ACA § 16 -17 -129 authorizes the City of Jacksonville to levy a fine of up to Twenty Dollars ($20.00) from each defendant in Jacksonville District Court who is found guilty, pleads guilty, pleads nolo contendre, and /or forfeits bond for any traffic and /or misdemeanor offense(s) in the District Court; and, WHEREAS, said fines collected shall be deposited into a special fund and used exclusively for the operations, maintenance, and capital expenditures of the City's detention facilities and for costs associated with the incarceration of City prisoners. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT ;; SECTION ONE: Under authority of ACA § 16 -17 -129, a levy of Twenty Dollars ($20.00) in additional fine(s) shall be made against each defendant in the Jacksonville District Court who is found guilty, pleads guilty, pleads nob contendre, and /or forfeits bond for any traffic and /or misdemeanor offense(s) in the Jacksonville District Court. Said additional fine(s) shall be assessed and collected from January 1, 2012, forward until otherwise amended or modified. SECTION TWO: Monies collected under authority of ACA § 16 -17- 129 through the Jacksonville District Court shall be deposited into a special fund to be used exclusively to help defray the costs of operations, maintenance, and capital expenditures of the City's detention facilities and costs associated with the incarceration of City prisoners. ORDINANCE NO. 1434 (422 — 2011) PAGE TWO SECTION THREE; All Ordinances or parts thereof in conflict herewith are hereby repealed to the extent of said conflict. SECTION FOUR: This Ordinance, necessary for the improvement of public facilities and the health, safety, and welfare of the citizens of Jacksonville, should be implemented immediately. Therefore, an emergency is hereby declared, and this Ordinance shall be in force and effect from and after its date of passage, with its date of implementation being January 1, 2012.
