1341 ORDINANCE NO. 1341 (#8 - 08)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE
OFA TEMPORARY STAGE FACILITY BY THE IACKSONVILLEADVERTISING
& PROMOTIONS COMMISSION; AND, FOR OTHER PURPOSES.
WHEREAS, the Jacksonville Advertising & Promotions Commission has
determined the need for a Temporary Stage Facility to be used at public events that
promote Jacksonville; and,
WHEREAS, Marshall Austin Productions of Morrison Colorado, is qualified to
provide such stage, with all appropriate attachments and fixtures as suggested and
as declared needed by the Commission. Marshall Austin Productions has agreed to
do so at a competitive cost, in a quick manner, and is a sole source of such a
facility. As such, the Commission recommends waiver of competitive bidding and
that they be allowed to contract with Marshall Austin to purchase the needed
Temporary Stage Facility with all appropriate fixtures.
NOW THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL 6F THE CITY 6F JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the purchase of a Temporary
Stage Facility and all fixtures for the Jacksonville Advertising & Promotions
Commission would be costly and non - productive, making said competitive bidding
unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived pursuant to ACA
§14 -58 -383, to authorize purchase of a Twenty-four Feet by Thirty Feet (24' x 30')
Marshall Austin Deluxe Temporary Stage Facility, together with all appropriate
fixtures, on behalf of the Jacksonville Advertising & Promotions Commission.
Authorization is hereby given to the Mayor and City Clerk or their designated
representative(s) to enter into a contract with Marshall Austin Productions of
Morrison, Colorado, for the purchase of said stage and fixtures on behalf of the City
by the Jacksonville Advertising & Promotions Commission at costs not to exceed
Seventy -six Thousand Seven Hundred Dollars ($78,700.00), together with applicable
tax. It is noted that Ten Thousand Dollars ($10,000.00) of said total purchase costs
shall be provided and paid through the proceeds of a State grant awarded to the
Jacksonville Chamber of Commerce, and the remainder shall be payable from the
proceeds of the tax revenues of the Advertising & Promotions Commission.
SECTION THREE: Ail Ordinances or parts of Ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION FOUR: This Ordinance shall take effect immediately upon
passage and publication as provided by and subject to applicable law.
