1336 0000 ORDINANCE NO, 1336 ( #3 - 08) AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE AND INSTALLATION OF FANS FOR THE JACKSONVILLE COMMUNITY CENTER; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. WHEREAS, the Jacksonville Community Center is in need of energy saving fans for the basketball courts and fitness areas. The RevolutionTM Fan by Rite -Hite will provide optimum air delivery and energy savings. In order to reduce energy costs, such fans need to be purchased and installed as soon as possible; and, WHEREAS, Johnson Equipment Company of North Little Rock, Arkansas, is qualified to provide and perform installation of the RevolutionTM Fan. Johnson Equipment Company has agreed to do so at a competitive cost and quickly. As such, the Department recommends waiver of competitive bidding and contracting with Johnson Equipment Company to purchase and install the necessary fans. NOW THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: Competitive bidding for the purchase and installation of energy saving fans for the Jacksonville Community Center would be costly and non- productive, making said competitive bidding unfeasible and impractical. SECTION TWO: Competitive bidding is hereby waived, pursuant to ACA §14-58-383, to authorize the purchase and installation of up to three (3) RevolutionTM Fans for the basketball courts and fitness areas for the Jacksonville Community Center. Authorization is hereby given to the Mayor and City Clerk to enter into a contract with Johnson Equipment Company of North Little Rock, Arkansas for the purchase and installation of said fans for the Jacksonville Community Center at a cost not to exceed Eighteen Thousand Three Hundred Seventy-five Dollars ($18,375.00), plus any applicable tax and shipping charges. SECTION THREE: All Ordinances, parts of Ordinances, or previous actions taken by said Council in conflict herewith are hereby repealed to the extent of such conflict. SECTION FOUR: This Ordinance, necessary for the improvement of public facilities and the health, safety, and welfare of the citizens ofJacksonville, should be implemented immediately. Therefore, an emergency is hereby declared, and this Ordinance shall be in force and effect from and after its date of passage. APPROVED AND ADOPTED THIS ISi" DAY OF MAY, 2008.
