1331 ORDINANCE NO. 1331 (# 30 -07)
AN ORDINANCE AMENDING JACKSONVILLE ORDINANCE NO. 1317
( #16 -07) APPROVING THE ISSUANCE OF REVENUE BONDS BY THE
CITY OF JACKSONVILLE, ARKANSAS HEALTH CARE
(DEVELOPMENTALLY DISABLED) FACILITIES BOARD; DECLARING AN
EMERGENCY; AND, PRESCRIBING OTHER MATTERS RELATING
THERETO.
WHEREAS, on July 19, 2007, the City Council of the City of
Jacksonville, Arkansas (the "City") adopted Ordinance No. 1317 ( #16 -07)
( "Ordinance No. 1317 "), which authorized the City of Jacksonville, Arkansas
Health Care (Developmentally Disabled) Facilities Board (the "Board ") to issue its
Revenue Bonds (Pathfinder Project), Series 2007 in the maximum principal
amount of $8,200,000 (the "Series 2007 Bonds "). The purpose of the Series
2007 Bonds, to refinance certain health care facilities described therein and to
finance the cost of the 2007 Project, consisted of: (a) acquiring, constructing,
and equipping a Preschool facility; and, (b) renovating and expanding the Jim
Pickens Skills Training Center by adding an additional floor. Pathfinder, Inc., an
Arkansas nonprofit corporation ("Pathfinder) shall own both facilities;
WHEREAS, Pathfinder request that the description of the Series
2007 Project in Ordinance No. 1317 be modified through reduction of the square
footage of the Preschool by One Thousand Square Feet (1,000 SF) and by the
construction of an expansion of the Jim Pickens Skills Training Center with
approximately Seven Thousand Six Hundred Square Feet (7,600 SF) of additional
program space rather than an additional floor having Six Thousand Four Hundred
Square Feet (6,400 SF) of additional program space; and,
WHEREAS, it is necessary to amend Ordinance No. 1317 to
authorize the Series 2007 Bonds to be issued to finance the 2007 Project as
described above.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OFJACKSONVILLE, ARKANSAS, THAT ::
SECTION ONE: The third WHEREAS clause of Ordinance No.
1317 is hereby amended to read as follows:
"WHEREAS, the 2007 Project will consist of: (a) acquiring,
constructing, and equipping an approximately Forty-one Thousand
Square Feet (41,000 SF) facility to be used as a Preschool, which
will be located within the Pathfinder complex at West Main Street
and North Redmond Road in Jacksonville; and, (b) constructing an
expansion to the Jim Pickens Skills Training Center, which is located
at 905 North Redmond Road in Jacksonville, which will result in
approximately Seven Thousand Six Hundred Square Feet (7,600
SF) of additional program space; and,"
SECTION TWO: If any provision of this Ordinance or the
application thereof to any person or circumstance is held invalid, such invalidity
shall not affect the other provisions or applications of this Ordinance, which can
be given effect without the invalid provision or application, and to this end the
provisions of this Ordinance are declared to be severable.

SECTION THREE: All Ordinances of the City, or parts thereof, in
conflict with this Ordinance are hereby repealed to the extent of such conflict.
SECTION FOUR: Ordinance No. 1317, as amended hereby, shall
remain and be in full force and effect.
SECTION FIVE: It is hereby ascertained and declared that the
2007 Project must be accomplished as soon as possible in order to provide
additional health care facilities for the developmentally disabled for the City.
Because the 2007 Project cannot be accomplished without the issuance of the
Series 2007 Bonds, it is declared that an emergency exists. This Ordinance,
being necessary for the preservation of the public peace, health, and safety, shall
be in force and take effect immediately upon and after its passage.
