ORDINANCE NO. 1319 ( #18 - 07)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE
INSTALLATION OF AN ELECTRIC VENTILATION SYSTEM FOR THE
JACKSONVILLE COMMUNITY CENTER; DECLARING AN EMERGENCY;
AND, FOR OTHER PURPOSES.
WHEREAS, the Jacksonville Community Center is in need of additional
ventilation in the ceilings to address the excessive moisture created by the Indoor
Pool. In order to prevent additional damages, such materials and installation need
to be purchased and installed as soon as possible; and,
WHEREAS, Howell Utilities of Little Rock, is qualified to provide and perform
installation of the electrical ventilation system and has worked in and is familiar with
the building construction. Howell Utilities has agreed to do so at a competitive cost
and in a quick manner. As such, the Department recommends waiver of
competitive bidding and that the City contract with Howell Utilities to purchase and
install the necessary materials and system.
NOW THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL 6F THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the purchase and installation of a
new electric ventilation system for the Jacksonville Community Center would be
costly and non - productive, making said competitive bidding unfeasible and
impractical.
SECTION TWO: Competitive bidding is hereby waived, pursuant to ACA
§14 -58 -383 to authorize the purchase and installation of an electric ventilation
system for the Jacksonville Community Center. Authorization is hereby given to the
Mayor and City Clerk to enter into a contract with Howell Utilities of Little Rock,
Arkansas for the purchase and installation of an electric ventilation system for the
Jacksonville Community Center at a cost not to exceed Forty-five Thousand Five
Hundred Dollars ($45,500.00).
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION FOUR: This Ordinance, necessary for the improvement of public
facilities and the health, safety, and welfare of the citizens of Jacksonville, should be
implemented immediately. Therefore, an emergency is hereby declared, and this
Ordinance shall be in force and effect from and after its date of passage.
