AN ORDINANCE AMENDING JACKSONVILLE MUNICIPAL
CODE §§ 17.12.020, 17.12.030, 17.12.110, 17.12.120,
17.12.140, 17.16.010, 17.16.020, 18.24.040, 18,26.040,
18.28.040, 18.32.040, 18.36.040, 18.37.040, 18.38.040,
18.39.040, 18 40.040, 18.44,040, 18.48.040, 18.52.040,
18.56.040, 18.60.040, 18.68.040, AND 18.68.050
REGARDING CERTAIN ZONING AND BUILDING PROVISIONS
AND REQUIREMENTS; CREATING JMC § 18.20.040;
DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES.
WHEREAS, certain provisions of the Jacksonville Municipal Code are in
need of amendments, revisions, and updates regarding building and zoning
requirements. After hosting a public hearing and discussions of these issues and
others on several occasions, with input from Commission members, members of
the public, and various parties involved in the construction industry locally, the
Jacksonville Planning Commission recommends the following amendments,
changes, deletions, and modifications to the Jacksonville Municipal Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Jacksonville Municipal Code § 17.12.020
(Sketch Plat) shall be amended as follows: The Sketch Plat shall be
presented to the City Engineer or the designated representative no less than Ten
(10) days prior to the Planning Commission meeting at which consideration is
requested. The date of submission of the Plat shall be entered thereon by the
City.
SECTION TWO: Jacksonville Municipal Code § 17.12.030
(Preliminary Plat) shall be amended as follows: The Preliminary Plat shall
be presented to the City Engineer or the designated representative no less than
Ten (10) days prior to the Planning Commission meeting at which consideration
is requested. The date of submission of the Plat shall be entered thereon by the
City.
SECTION THREE: Jacksonville Municipal Code § 17.12.110 (Final
Plat) shall be amended as follows: The Final Plat shall be presented
to the City Engineer or the designated representative no less than Ten (10) clays
prior to the Planning Commission meeting at which consideration is requested.
The date of submission of the Plat shall be entered thereon by the City.
Further, Subsections One and Two shall include requirements for
submission of the Jacksonville Water Commission and Jacksonville Wastewater
Commission acceptance and approval of said plans and systems prior to
submission of the Final Plat to the Jacksonville Planning Commission, completion
of all sidewalks and other improvements as required and /or a satisfactory bond
or cash posted with the City of an amount equal to the construction costs of said
improvements not completed before Commission approval, appropriate Storm
Water Controls implemented to the Best Management Practices possible, and all
other such improvement requirements as provided in applicable Codes herein.
SECTION FOUR; Jacksonville Municipal Code § 17.12.120 (Final
Plat Approval) shall be amended to allow that action shall be taken by the
Commission to approve or deny a Final Plat within Sixty (60) days from its date
of receipt. If not, said Final Plat shall automatically be placed on the next

regularly scheduled Planning Commission agenda and addressed so as not to
unreasonably delay any property owner.
SECTION FIVE; Jacksonville Municipal Code § 17.12.140 (Final
Plat- Submission Time Limitation) shall be amended to include: The Final Plat
shall be filed and recorded in the Office of the Circuit Clerk within Sixty (60) days
of approval by the Planning Commission. If not filed within said timeframe, said
approval shall be considered void.
SECTION SIX: Jacksonville Municipal Code § 17.16.010 (Plat
Information Requirements) and Jacksonville Municipal Code § 17.16.020
(Information Submissions) shall be amended to include the following
requirements: Appropriate Zoning compliance prior to submission for
Preliminary Plat approval; Water Commission and Wastewater Commission plan
approval prior to Preliminary Plat approval; Water Commission and Wastewater
Commission acceptance and approval prior to Final Plat approval; Storm Water
Drainage and Control Plans prior to Preliminary Plat approval; Storm Water
Drainage and Control Improvements installed prior to Final Plat approval; and, all
improvements, streets, water, sewer, sidewalks, and otherwise, installed,
approved, and accepted prior to Final Plat approval.
SECTION SEVEN: Jacksonville Municipal Code §§ 18.24.040,
18.26.040, 18.28.040, 18.32.040, 18.36.040, 18.37.040, 18.38.040, 18.39.040,
18.40.040, 18.44.040, 18.48.040, 18.52.040, 18.56.040, 18.60.040, 18.68.040,
and 18.68.050 shall hereby be amended to allow and require a Twenty-five feet
(25') front setback for all street frontages of said property (ies).
SECTION EIGHT :: Jacksonville Municipal Code § 18.20.040
(Dimensional Requirements) shall he created and shall read as follows: For
dimensional requirements for the A -1 zoning district, please see JMC §
18.68.050, Chart No. 1.
SECTION NINE: All ordinances or p arts of ordinances in conflict
herewith are hereby repealed to the extent of said conflict(s).
SECTION TEN: Because implementation of the above certain
changes are necessary for efficient and effective construction and zoning
provisions for the City of Jacksonville, there is a need for immediate
implementation of this Ordinance. As such, this Ordinance shall be in effect from
and after its date of passage, subject to and by applicable publication, as
provided by and subject to the requirements of applicable law.
