AN ORDINANCE AMENDING JACKSONVILLE MUNICIPAL CODE § 9,38,030
(FALSE ALARMS - NUISANCE); AND, FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville, Arkansas (the "City"), as a city of the first
class, has endured an excessive number of false alarms from residential and
business alarm systems; and,
WHEREAS, because of additional uncontrollable circumstances, the City
Council has determined that it would be in the best interests to allow additional
exceptions to the imposition of certain fees for alarm systems which malfunction
and sometimes require unneeded emergency services responses.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT ::
SECTION ONE; Jacksonville Municipal Code § 9.38.030 is hereby
modified and shall read as follows:
3MC § 9.38.030 DEFINITIONS.
False Alarms -- An alarm signal eliciting a response by the Police or Fire
Department when a situation requiring a response by the Police or Fire Department
does not in fact exist.
False alarms shall not include an alarm signal caused by violent conditions of nature
or other extraordinary circumstances not reasonably subject to control by the alarm
business operator or alarm user. Alarms resulting from the following conditions will
not be considered false alarms: criminal activity or unauthorized entry into a
structure, building, or property; an alarm caused on the reasonable but mistaken
belief that a burglary, robbery, or other criminal offense, fire emergency, or medical
emergency is in progress; telephone line /communication transfer line malfunction
verified in writing to the City by a first -line company supervisor; alarm equipment
malfunction during installation and /or service rehabilitation as verified in writing by
the alarm service /monitoring company; and, electrical service interruption verified
in writing by the local power company.
Resident(s) or business(es) installing a new system or making substantial
modification to an existing alarm system shall be entitled to a grace period during
which alarms generated by the new or improved system shall not be deemed false
alarms. Written verification of such installation /modification is required from the
alarm service /installer. Such a grace period shall last no longer than thirty (30) days
after installation of or modification to an alarm system.
Exceptions will also be made for circumstances when communication from the
property owner /manager and /or the alarm monitoring service to the 911
Communications Center before dispatch of a responding unit(s) occurs clearly
indicating that the alarm resulted from authorized entry, authorized system testing,
or other non - criminal /non - emergency cause(s).
SECTION TWO: The provisions of this Ordinance are hereby
declared to be severable. If any section, phrase, or provision shall be declared or
held invalid, such invalidity shall not affect the remainder of the Ordinance.

SECTION THREE: All Ordinances and parts of Ordinances in conflict
herewith are hereby repealed to the extent of said conflict.
SECTION FOUR: This Ordinance shall take effect from and after its
date of passage pursuant to and by applicable law.
