0519 ORDINANCE NO. , 12 AN ORDINANCE ESTABLISHING REGULATIONS FOR THE LOCATION AND PLACEMENT OF FIRE HYDRANTS IN THE CITY OF JACKSONVILLE, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES. WHEREAS, the Fire Department has an objective and purpose to control and prevent fire and also to protect lives and pro- perty within the City; and, WHEREAS, the Water Department has an objective and pur- 1 pose to provide a potable water supply for the citizens of the City of Jacksonville in sufficient quantity to provide adequate fire protection for the City of Jacksonville; and, WHEREAS, the location and placement of fire hydrants is essential to the fighting of fires and proper engineering is essential in the placement of fire hydrants for the purpose of maintaining sufficient fire fighting pressures, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: Section 1. All subdivisions within the City of Jacksonville, Arkansas, shall meet the following minimum re- quirements: A. Fire hydrants in commercial and industrial areas shall be no more than 500 feet apart. B. Fire hydrants in residential areas shall be no more than 1000 feet apart. Section 2. To obtain approval for fire hydrant place- ment within either a residential or industrial subdivision, a developer must present a set of plans (prepared by a Profes- sional Engineer) to the Jacksonville Water Department. Upon review of these plans, the Water Department Manager will give his approval or disapproval of said plans. Section 3. Plans will then be presented to the Fire Chief, or his designate within the Fire Department, for his study and approval or disapproval. Section 4. The Engineer retained by the Jacksonville Water Commission, or a Registered Professional Engineer employed by the Water Department, must give his approval as to line size, pressure available and volume of water available to the pro- posed development. Section 5. Upon approval of the Water Department Manager and the Jacksonville Fire Chief, the Water Commission will write a letter to the Jacksonville Planning Commission giving its approval of the plans for the development. All parties shall give their approval in writing. CITY OF JACKSONVILLE PAGE TWO ORDINANCE NO. Section 6. If any section, sentence, or clause of this Ordinance shall be declared unconstitutional or invalid, same shall not defeat the balance of this Ordinance. Section 7. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of any such conflict. Section 8. This Ordinance being necessary for the immediate preservation of the public health, safety, welfare and morale of the citizens of the City of Jacksonville, Arkansas, an emergency is hereby declared to exist and this Ordinance shall be in full force and effect immediately after its passage.
