AN ORDINANCE ESTABLISHING A DEPARTMENT OF COMMUNITY DEVELOPMENT
FOR THE CITY OF JACKSONVILLE, ARKANSAS, CREATING THE POSITION OF
DIRECTOR OF COMMUNITY DEVELOPMENT, AND PROVIDING FOR THE DUTIES
AND POWERS OF SAID DIRECTOR OF COMMUNITY DEVELOPMENT.
WHEREAS, the City of Jacksonville, Arkansas, is desirous of undertaking
community improvement activities with funds from the U.S. Department of Hou-
sing and Urban Development and other grantor agencies for the continued ben-
efit of the residents of the City of Jacksonville, Arkansas; and,
WHEREAS, it has been determined that a more efficient management of said
activities and the city's resources could be obtained with the establishment
of a Department of Community Development and that said department is desired;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACK -
SONVILLE, ARKANSAS, THAT:
Section 1. There is hereby added to the Jacksonville Municipal Code a
Chapter 2.80 which is to read as follows:
2.80.005 There is hereby established a Department of Community Develop-
ment for the City of Jacksonville, Arkansas, which is to be headed by a Di-
rector of Community Development, who shall be appointed by the Mayor and ap-
proved by the City Council and who may be removed as provided in 2.80.060.
Said Director shall be directly responsible to the Mayor and City Council.
2.80.010 Equipment, supplies, and office space as is necessary for the
operation of the Department of Community Development and the performance of
the duties prescribed hereinafter, to be used by the Director of Community De-
velopment and /or his department shall be provided and owned by the city. Di-
rector shall endeavor to utilize funds from the grants -in -aid to cover costs
of the above whenever such funds for this purpose are available to the Direc-
tor.
2.80.020 The qualifications of said Director shall be that he is a grad-
uate of an accredited institution of higher learning with at least a Bachelor's
Degree; that he has knowledge of the various grants -in -aid programs; that he
has a command of the English language; and that he is a resident and qualified
elector of the City of Jacksonville, Arkansas, at all times after appointment.
At least five years experience in a management position related to grants -in-
aid may be substituted for the educational requirement at the discretion of
the Mayor and City Council.
2.80.030 All benefits applicable to non - uniformed employees as set forth
in the "Employee Classification and Management System" shall apply to the Di-
rector and all personnel within the Department of Community Development.
2.80.040 The duties of the Director of Community Development shall include
but are not limited to the following:
A. Be the chief administrative official of the Department of Community
Development;
B. Prepare applications for grants -in -aid programs as directed by the
Mayor and City Council; preparation shall be either solely or in conjunction
with other city personnel and /or outside engineers and /or consultants;
C. Administer all grants -in -aid programs as directed by the Mayor and City
Council; administration shall be either solely or in conjunction with other city
personnel and /or outside engineers and /or consultants;
D. Cooperate with the Finance Director to insure a complete accounting
system is established for all grants -in -aid funds received;
E. Cooperate with all federal, state, and local monitors and /or auditors
on all financial matters relating to grants -in -aid funds received and act as
quickly as possible to correct adverse findings, if any, which may be found as
the result of an audit and /or monitoring;
F. Attend meetings, seminars, and workshops locally, statewide, and nation-
ally which are significant to the operation of the Department and for profession-
al enrichment;
G. Attend all City Council meetings and present materials relative to the
Department to the Mayor and City Council;
H. Attend and conduct all Public Hearings relative to community development
and other grants -in -aid programs;
I. Ensure, to the best of his ability, that all regulations relative to the
grants -in -aid programs are adhered to and that all requirements pertaining to same
are met which include but are not limited to the following:
1. Affirmative Action and Equal Opportunity
2. A -95 Review and Comment
3. Bidding and procurement standards
4. OMB Circular A -102 and FMC 74 -4 and FMC 74 -7
5. Federal Register and related regulation manuals requirements
J. Prepare and submit an annual budget document to the Mayor and City
Council and discuss same with the Mayor and City Council;
K. Prepare and submit an annual report to the Mayor and City Council; pre -
pare all required reports for all grantor agencies as required by the program
rules and regulations;
L. Endeavor to include his salary in grants -in -aid budgets where such an
expense is allowable under the program rules and regulations;
M. Perform any and all other work required for the compliance with the
rules and regulations of the various grants -in -aid programs except where such
work is of a professional nature beyond the scope of the Director's ability;
work of a professional nature may include but is not limited to the following:
engineering work, complex planning work, drafting work, and work which may be
too time consuming to be performed by the Director when a short time span for
submission of an application is given;
N. Perform any and all other work as directed by the Mayor and City Coun-
cil related to grants -in -aid except as noted above; such other work may in-
clude but is not limited to the following: planning and management studies,
technical assistance to other city departments and/or other agencies; coordin-
ation between different city departments involved in grants -in -aid projects;
2.80.050 The powers of the Director of Community Development shall be
the customary powers of the chief executive of a department and shall include
but are not limited to the following:
A. To hire and terminate personnel within the Department of Community
Development;
B. To arrange workloads in the department;
C. To execute the provisions of this ordinance as interpreted by the Ma-
yor and City Council within the scope of their authority;
D. To execute any other such powers as delegated by the Mayor and City
Council;
2.80.060 The failure to perform the duties as set forth in this ordinance
when such failure is intentional on the part of the Director except when such
duties are in violation of rules and regulations applicable to the grants -in-
aid program or when such duties are in violation of the law constitutes grounds
for removal. It shall take the affirmative vote of two - thirds of the elected
City Council to cause such removal and upon such action the City Clerk shall
give written notification to the Director of such action at least thirty days
in advance of the termination date.

Section 2. If any section, sentence, or clause of this ordinance shall be
declared to be unconstitutional or invalid, same shall not defeat the balance
of this ordinance.

Section 3. This ordinance supercedes any other ordinance or part of any
other ordinance in conflict with the provisions set forth herein.
Section 4. Whereas, it is imperative that the city establish the Depart-
ment of Community Development and create the position of Director of Community
Development, and whereas this ordinance is necessary for the immediate pro-
tection of the public peace, health, and safety, an emergency is hereby de-
clared to exist and this ordinance shall be in full force and effect from and
after its passage and approval.
