0510 4 • ORDINANCE NO. 5 1 0 AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF THE CITY OF JACKSONVILLE, ARKANSAS, THE QUESTION OF LEVYING AN ADDITIONAL ANNUAL TAX OF ONE -HALF MILL ON THE DOLLAR UPON THE ASSESSED VALUE OF THE REAL AND PERSONAL PRO- PERTY WITHIN THE CITY FOR THE PURPOSE OF THE FIREMEN'S PENSION AND RELIEF FUND IN ACCORDANCE WITH ACT 491 OF 1921, AND AMENDMENTS THERETO, OF THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the City of Jacksonville, Arkansas, is a city of the first class and is authorized by Amendment 31 of the Consti- tution of the State of Arkansas to levy an annual tax of not to exceed one mill on the dollar upon the assessed value of all real and personal property within such city for the purpose of paying firemen retirement pensions and pensions to the widows and minor children of deceased firemen and widows and minor children of deceased retired firemen; and, WHEREAS, at the present time an annual tax of one -half mill is being levied on the dollar of assessed value of real and personal property and such assessment is not sufficient to provide for a sound and judiciously administered pension fund for securing and retaining the services of a most faithful and efficient class of individuals connected with the fire department, a municipal service in which every property owner and resident of this city is vitally interested; and, WHEREAS, Jacksonville is one of the few municipalities which is not presently levying a one mill tax to provide for the benefit of the firemen's pension fund; and, WHEREAS, it is the opinion of the City Council of the City of Jacksonville, that it is for the best interest of the City of Jacksonville, Arkansas, that such a pension and relief fund be established; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS: SECTION 1. That there shall be submitted to the qualified electors of the City of Jacksonville, Arkansas, at the general election to be held on the 7th day of November, 1978, the ques- tion of the levy of an additional annual tax of one -half mill on the dollar upon the assessed value of all real and personal property within the city for the purpose of paying pensions to retired firemen and pensions to widows and minor children of retired firemen and widows and minor children of deceased retired firemen. SECTION 2. That the ballot title shall appear as follows: "The Question of Levying an additional annual tax of one -half mill on the Dollar of the Assessed Value of the Real and Personal Property within the City and for the Purpose of the FIREMEN'S PENSION AND RELIEF FUND in Accordance with Act 491 of 1921, and Amend- ments Thereto, of the General Assembly of the State of Arkansas." ORDINANCE NO. V v PAGE 2. SECTION 3. That the question shall be placed on the ballot for the general election in substantially the following form: "Vote on measure by placing an 'X' in the square beside the measure either for or against: "FOR LEVYING AN ADDITIONAL ANNUAL TAX OF ONE -HALF MILL FOR THE FIREMEN'S PENSION AND RELIEF FUND / "AGAINST LEVYING AN ADDITIONAL ANNUAL TAX OF ONE -HALF MILL FOR THE FIREMEN'S PENSION AND RELIEF FUND / SECTION 4. That the election shall be held and conducted and the vote canvassed and the results declared under the law and in the manner provided for municipal elections, so far as the same may be applicable, and the Mayor shall give notice of such election by an advertisement published once a week for four consecutive weeks in a newspaper having a bona fide circulation in the city, with the last publication to be not less than ten days prior to the date of the election, and only qualified electors of the city shall have the right to vote at said election on said question. SECTION 5. That the results of said election shall be pro- claimed by the Mayor and his proclamation shall be published one time in a newspaper having a bona fide circulation in the city, which proclamation shall advise that the results as proclaimed shall be conclusive unless attacked in the courts within thirty (30) days after the date of such proclamation. SECTION 6. That a copy of this Ordinance shall be furnished to the Pulaski County Board of Election Commissioners so that the necessary election officials and supplies may be provided. SECTION 7. That in the event of the approval of the tax levy by the qualified electors of the City of Jacksonville, Arkan- sas that such steps be taken as are necessary to comply with the will of the people as expressed in said election. SECTION 8. This ordinance being necessary for the immediate preservation of the public health, safety, welfare and morale of the citizens of the City of Jacksonville, Arkansas, an emergency is hereby declared to exist and the above Ordinance shall be in full force and effect immediately after its passage.
