AN ORDINANCE VACATING AND ABANDONING A PORTION OF A
12 FOOT SANITARY SEWER EASEMENT OVER AND ACROSS THE
SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SEC-
TION 24, TOWNSHIP 3 NORTH, RANGE 11 WEST, PULASKI
COUNTY, ARKANSAS; DECLARING AN EMERGENCY; AND FOR
OTHER PURPOSES
WHEREAS, the City of Jacksonville did and has acquiu: .,.
interest in numerous right -of -ways and easements for public
utilities and drainage by grant, purchase, or condemnation; and,
WHEREAS, many of said right -of -ways and easements are no
longer functional, serviceable, or required for corporate pur-
poses; and,
WHEREAS, the City Council of the City of Jacksonville
has determined that that portion of a certain Sanitary Sewer
Easement in the Southeast Quarter of Section 24, Township 3
North, Range 11 West, Pulaski County, Arkansas, described in
Section 1 hereof is not necessary for a Sewer Easement or other
corporate purposes and desires to vacate and abandon all its
right, title and interest together with that of the public
generally in said Sewer Easement pursuant to the power granted
cities of the first class by Section 19.2304, Arkansas Statutes
Annotated.
NOW THEREFORE, be it ordained by the City Council of the
City of Jacksonville, Arkansas that:
SECTION 1. The City of Jacksonivlle, Arkansas, hereby
vacates and abandons all its right, title, and interest together
with that of the public generally in and to the following described
property, to -wit:
(describing that portion of the Subject 12 foot
sewer right -of -way to be abandoned as reflected
on the survey prepared by T. R. Bond, Registered
Land Surveyor, dated March of 1977, and showing
Sanitary Sewer Easements field located on May
26, 1978, a copy of which is attached hereto)
Beginning at the Southeast Corner of Section 24,
Township 3 North, Range 11 West, thence North
along the East line of said Section 24, Town-
ship 3 North, Range 11 West a distance of 1043.4
feet to a point; thence South 44 degrees 45
minutes West 27.9 feet (measures South 45
degrees 03 minutes 14 seconds West 27.84 feet);
thence South 46 degrees 43 minutes West 204.1
feet (measures South 46 degrees 42 minutes
14 seconds West 203.95 feet); thence South 40
degrees 52 minutes West 159.98 feet; thence
South 79 degrees 14 minutes West 20 feet to the
centerline and the point of beginning of a 12
foot sewer right - - way herein described; thence

North 07 degrees East 182 feet to a point the
same being a point of intersection of a 10
foot sewer easement and a 12 foot sewer ease-
ment and the end of the sewer right -of -way herein
described.
SECTION 2. This ordinance being necessary for the immec-
iaCe preservation of the public health, safety, welfare and
morale of the citizens of the City of Jacksonville, Arkansas,
an emergency is hereby declared to exist and the above Ordinance
shall be in full force s and effect imme., ately after its passage
of
