At7 r AN ORDINANCE DECLARING ALL SEATS ON THE JACKSONVILLE PARKS AND RECREATION COMMISSION VACANT; AMENDING ORDINANCE 289 OF 1973 AND ORDINANCE 190 OF 1967; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, that: SECTION 1. All seats on the Jacksonville Parks and Recreation Commission are hereby declared to be vacant and shall remain such until their duly nominated and qualified successors are named by the Mayor and City Council. SECTION 2. Ordinance No. 289 Sections 1 and 2 of 1973 and Ordinance No. 190 Section 3(1)(a)(1,3) 1967 is hereby amended to read as follows: "A Park and Recreation Commission consisting of five members is established. Members shall be qualified voters of the City and shall serve without compensation." SECTION 3. Ordinance No. 190 Section 3(1)(a)(2,4) of 1967 is hereby amended to read as follows: "Members shall be appointed by the Mayor and confirmed by a majority vote of the duly elected members of the City Council and shall hold office for a term of five years; provided however, that those commissioners first appointed and confirmed shall serve for terms of one, two, three, four and five years each to be designated by the Mayor and City Council and thereafter, upon expiration of their respective terms Commissioners appointed by the Mayor and approved by a Majority of the City Council shall each be appointed for a term of five years. In the event of a vacancy occu- ring on the Commission it shall be filled by ap- pointment by the Mayor subject to approval of majority vote of the duly elected and qualified members of the City Council. Each Couuuissioner shall file the oath required by law in the State of Arkansas of public officials. Any Commissioner appointed by the provisions of this Ordinance may be removed for cause upon a two - thirds vote of the duly elected and qualified members of the Council. Provided further, that if a replacement has not been designated upon the end of a member's term, then that member shall continue his member- ship until replaced." "Provided that no member shall be qualified /allowed to serve more than two (2) consecutive terms." SECTION 4. This Ordinance being necessary for the imme- diate preservation of the public health, safety, welfare and morale of the citizens of the City of Jacksonville, Arkansas, an emergency is hereby declared to exist and the above Ordinance shall be in full force and effect immediately after its passage.
