AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF JACKSONVILLE,
ARKANSAS, VACATING AND CLOSING FRONT STREET BETWEEN PINE STREET
AND WALNUT STREET IN THE CITY OF JACKSONVILLE, ARKANSAS.
WHEREAS, a petition was duly filed with the City Council
of the City of Jacksonville, Arkansas, on this 16th day of
March , 1978, asking the City Council to vacate
and abandon that portion of Front Street lying between Pine
Street and Walnut Street in the City of Jacksonville, Arkansas,
as designated on the plat of the city now appearing of record
in Plat Book 2, Page 53, in the office of the Recorder of Pulas-
ki County, Arkansas, subject, however, to any public easements
in said street; and
WHEREAS, after due notices as required by law, the City
Council has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and has
ascertained that the street, herein before described, has here-
tofore been dedicated to the public use as a street, as herein
described; has not been actually used by the public for a period
of at least five (5) years subsequent to the filing of the plat;
that all of the owners of the property abutting upon the street
to be vacated have filed with the City Council their written
consent to such abandonment; and that public interest and welfare
will not be adversely affected by the abandonment of such street;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS;
SECTION 1: The City of Jacksonville, Arkansas, hereby
releases, vacates and abandons all its rights, together with the
rights of the public generally, in and to the street designated
as follows:
Front Street Lying between Pine Street and Walnut
Street in the City of Jacksonville, Arkansas, sub -
ject however, to any public utility easements lo-
cated in said street.
SECTION 2: A copy of this Ordinance, duly certified by
the City Clerk,shall be filed in the office of the Recorder of
Pulaski County and recorded in the Deed Books of the County.
SECTION 3: This Ordinance shall take effect and be in
force from and after its passage.
