0469 ORDINANCE NO. 4 6 9 AN ORDINANCE AMENDING ORDINANCE NUMBER 150, SECTION 2, PARA- GRAPH A, DECLARING AN EMERGENCY TO EXIST, AND FOR OTHER PURPOSES (REGARDING SANITATION FEES) WHEREAS, it is necessary for the preservation of the public health, safety and morale of the citizens of the City of Jacksonville, Arkansas, that all areas within the said city be free of garbage and rubbish; and WHEREAS, it is necessary that rates be adjusted to provide necessary city services to this end; and WHEREAS, Ordinance Number 150 adopted certain rates which are at this time inequitable in light of additional costs; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, that: SECTION 1. That Section 2, Paragraph A, be and the same is hereby amended to read as follows: A. The Monthly Rates shall be as follows and shall apply in all cases of occupancy of one month or any part thereof: 1) Three and 50/100 ($3.50) Dollars for each single family resident. 2) Three and 50/100 ($3.50) Dollars for each trailer space. 3) Three and 50 /100 ($3.50) Dollars for each residential unit of each duplex and of each apartment building. 4) Five and no /100 ($5.00) Dollars for each office. 5) Five and no /100 ($5.00) Dollars for each building occupied as a residence and a service -type business not engaged in the actual sale of merchandise and requiring no additional service as a result of said business. 6) Upon all other businesses, not exempted by Para- graph 4 and 5 hereof, the rates shall be subject to negotiation by an arbitrary board, which is hereby created for such purpose. The arbitrary board shall be composed of the Landowner, the Mayor of the City of Jacksonville, the head of the Sanitation Department of the City of Jacksonville, and one disinterested party to be mutually selected by the said Landowner and the Mayor. Provided further that the minimum fee shall not be less than Five and no /100 ($5.00) Dollars. ORDINANCE NO. 4 6 9 PAGE TWO SECTION 2. That all ordinances inconsistent with the provisions of this ordinance shall be, and the same are hereby repealed. SECTION 3. That this Ordinance being necessary for the immediate preservation of the public health, safety, welfare and morale of the citizens of the City of Jacksonville, Arkansas, an emergency is hereby declared to exist and the above quoted rates should go into full force and effect on the date of its passage.
