AN ORDINANCE A UTHORIZING PAYMENT FOR SERVICES RENDERED IN REPAIR
OF THE LOOP ROAD BRIDGE; DECLARING AN EMERGENCY; AND, PRESCRIBING
OTHER MA TTERS RELA TING THERETO.
WHEREAS, the City's Street Department has been addressing road and bridge repair
needs for some time, particularly that for the Loop Road Bridge. In examining and
researching repairs needed, authorization has been given for emergency repairs made to the
Loop Road Bridge recently to insure the safety and adequate support is provided for the
traffic needs of that area of town;
WHEREAS, in doing so, while costs were reasonable, the necessary bridge repairs
exceeded the amount anticipated, requiring the Street Department to approve repairs
beyond the appropriate expenditure amount prior to either bidding or waiving bidding
requirements under State law; and,
WHEREAS, THOMCO, INC. of North Little Rock, Arkansas, has provided services and
repairs to remove, reinforce, and restore the pre -cast concrete units and caps supporting
said bridge. While costly, THOMCO's services were at a savings to the City, but additional
repairs were required totaling Thirty-one Thousand Two Hundred Dollars ($3I,200.00). As
a result, a competitive bidding process would be costly, counter-productive to the City's
immediate needs, and would not serve to benefit the City/its citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF JACKSONVILLE, ARKANSAS, THAT;
SECTION ONE., Competitive bidding for the recently needed
improvements, service, and maintenance work performed on the Loop Road Bridge as noted
on the attached would be costly and non-productive, making said competitive bidding
unfeasible and impractical. Competitive bidding is hereby waived, pursuant to ACA
§14-58-383, to authorize payment of the services rendered by THOMCO, INC. of North Little
Rock for the repairs and services provided on Loop Road Bridge on the attached Invoice.
Authorization is hereby given to the Mayor and/or his authorized representative(s) to
approve payment of THOMCO, INC. for said repair and maintenance services, all for a total
cost not to exceed Thirty-one Thousand Two Hundred Dollars ($31,200.00) for payment of
the outstanding invoice for said services rendered.
SECTION TWO. The City Council hereby finds that the needed upgrades
and improved bridge structure is necessary and will, hopefully, save the City from expending
more repair funds in the future.

SECTION THREE: The provisions of this Ordinance are hereby declared to
be separable and if any provision shall for any reason be held illegal or invalid, such holding
shall not affect the validity of the remainder of this Ordinance.
SECTION FOUR: Ali Ordinances and Resolutions or parts thereof in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION FIVE- This Ordinance, because of the immediate need to
improve the public safety of the citizens who utilize said bridge, requires that an emergency
is hereby declared. As a result, this Ordinance shall take effect immediately upon passage
and publication, as provided by and subject to the requirements of applicable law.
