AN ORDINANCE AMENDING SECTION 4 AND SECTION 5 OF ORDINANCE NUM-
BER 436 OF 1977 AND SECTION 2.64.040 AND 2.64.050 OF THE JACK-
SONVILLE MUNICIPAL CODE; DECLARING AN EMERGENCY; AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACK-
SONVILLE, ARKANSAS, that;
SECTION 1. That Section 4 of Ordinance Number 436 and
Section 2.64.040 of the Jacksonville Municipal Code is hereby
amended to read as follows:
"The salary to be paid the Public Defender shall not
be less than Thirty -five Hundred and no /100 Dollars
($3,500) nor more than Fifty -five Hundred and no /100
Dollars ($5,500). Said salary being set by the muni-
cipal Judge and requiring approval of the City Council'.'
SECTION 2. Section 5 of Ordinance Number 436 and Sec-
tion 2.64.050 of the Jacksonville Municipal Code is hereby
amended to read as follows:
"There shall be levied and collected the sum of Two
Dollars ($2.00) by both the criminal and traffic divi-
sions of the Municipal Court from each defendant upon
each conviction, judgment of conviction upon each plea
of guilty or nolo contendere, in each case heard and
determined by the criminal and traffic divisions of
the Municipal Court of this City. For each moving
violation for which a fine is paid, without contest
in municipal traffic court, there shall be levied
and collected the sum of One Dollar ($1,00). All
* costs imposed by this chapter shall be paid
into the City's general fund, and said moneys are to
be used to fund the salary of the public defender.
Additionally, said money shall be used to cover inci-
dental costs approved by the City Council, for the
operation and implementation of said program, and to
cover additional Municipal Court costs."
SECTION 3. All ordinances or parts of ordinances in con-
flict herewith are hereby repealed to the extent of such conflict.
SECTION 4. This ordinance being necessary for the imme-
diate preservation of the public health, safety, welfare and morale
of the citizens of the City of Jacksonville, Arkansas, an emer-
gency is hereby declared to exist and this ordinance shall have
full force and effect immediately and after its approval and pas-
sage.
