WHEREAS, the City Council of the City of Jacksonville,
deems it necessary
for the

situations where such pLueeedure is deemed not feasible or
practical, procedure
WHEREAS, Act 28 of 1959 of the General Assembly of the
State of Arkansas and Ark. Stat. 19 -4425 provides that the City
Council may, by ordinance, waive the requirements of competitive
bidding, and
WHEREAS, the City Council of the City of Jacksonville deems
it necessary to establish such an ordinance, and
WHEREAS, the Water Department of the City of Jacksonville
presently has a Burroughs L -9 Computer and is desirous of obtain-
ing a Burroughs L -9000 which is the companion computer to the
computer that the Water Department presently has, and
WHEREAS, to obtain a computer from a different company
would not be feasible because of the different service contract,
different programs that would have to be obtained, making such
a course of action impractical, and
WHEREAS, the City Council of the City of Jacksonville deems
it necessary to authorize the Water Department to purchase an
identical type computer as the one that the Water Department is
presently using, the City Council deems it necessary to waive the
requirements of competitive bidding on the purchase of this com-
puter by the Water Department.
NOW THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, that:
Section 1. That the Water Department of the City of Jack-
, sonville is authorized to purchase from the Burroughs Computer
Corporation,an L -9000 Computer which is the companion computer
to the system that the Water Department presently has.
Section 2. That the City Council of the City of Jackson-
' ville, deems it necessary to waive the requirements of competitive
bidding due to the fact that such bidding would not be practical
or feasible under the circumstances where the Water Department
would have two different computer systems.
Section 3. This ordinance being necessary for the imme-
diate preservation of the health, safety and morale of the citi-
zens of the City of Jacksonville, Arkansas, an emergency is here -

diately upon its passage and approval.
