0453 • 453 ORDINANCE NO. AN ORDINANCE AMENDING ORDINANCE NUMBERS 213 AND 238 PERMITTING ZERO LOTLINE, SINGLE- FAMILY DISTRICT TO BE ADDED TO JACKSONVILLE MUNICIPAL CODE TO BE OFFICIALLY ENTITLED R -5 ZERO LOTLINE, SINGLE- FAMILY DISTRICT - RESIDENTIAL AND FOR OTHER PURPOSES. WHEREAS, the Jacksonville Planning Commission has recommended to the Jacksonville City Council that it would be beneficial to the city that the Jacksonville Municipal Code be amended. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, that: Section 1. Sections 18.16.010, 18.16.020 and 18.16.030 of the Jack- sonville Municipal Code is hereby amended to add the following: Section 18.16.010 Districts Established. R -5 Zero Lotline, One - Family District - residential Section 18.16.020 Map R -5 district to be included in zoning map. Section 18.16.030 Districts - Boundaries R -5 district to be included in rules that apply under reg- ulations covering district boundaries described therein. Section 2. Ordinances 213 and 238 are hereby amended to add the following requirements for R -5 district: Purpose for establishment. The R-5 district is established to permit the developing of single - family attached dwellings providing for high d 9 P g g density development allowing for abolishment of side lotline requirements except where zero lotline housing construction is broken as outlined in development re- quirements contained in this ordinance. Land development costs can con- ceivably be reduced with said concept of attached housing allowing single - family dwelling units to be made available on the market at lower costs to individual homeowners. Permitted Uses. The permitted uses in the R -5 district are: Attached single - family dwelling units. Any use permitted in R -0 and R -1. Conditional Uses. The conditional uses in the R -5 district are: Other :Qammunfty facilities. Public utility facility. Dimensional Requirements. Signs Sign provisions are the same as allowed in R -0 and R -1 districts. Section 3. The development requirements covering an R -5 district are as follows: 1. Each interior lot for zero lotline housing shall be not less than twenty (20) feet, and each end lot in zero lotline housing unit shall be not less than thirty -seven (37) feet, six (6) inches wide, except that where the end lot is adjacent and lengthwise to a street, no building or structure will be per- mitted within the twenty -five (25) feet building setback area. 2. Lot Area. Each interior lot of zero lotline housing shall be not less than 1,600 square feet and shall provide not less than fifty (50) percent of the lot area as unobstructed open space. Each end lot of a zero lotline housing unit shall be not less than 3,000 square feet and shall provide not less than fifty (50) percent of the lot area as unobstructed open space. 3. Minimum Required Front Yard. Where a zero lotline housing unit fronts onto a street, or court, or open space, the setback dis- tance shall be not less than twenty -five (25) feet from the front property line. In the case of a lot having frontage on two (2) streets which do not intersect on the lot boundaries, then the front yard requirements shall be met on both streets. 4. Minimum Side Yards. For the end lot of a zero lotline housing unit there shall be one (1) side yard of at least fifteen (15) feet or •greater where needed to maintain a minimum of thirty (30) feet spacing between buildings. 5. Minimum Rear Yard Requirements. There shall be a rear yard having a depth of not less than twenty -five (25) feet. 6. Maximum Height. For maximum height requirements for the R -5 district, see Chart No. 1, Chapter 18.68. (Ord. 213 , 1969) Amended chart is attached, Exhibit A. PAGE THREE ORD. NO. 4 5 3 7. Location of Accessory Buildings. No accessory building shall be located on any required front or side yard, or within five (5) feet of any lotline, that is not a street line. Fences up to ninety -six (96) inches in height may be erected along any boundary of the end side yards or rear yard from the rear of the lot for- ward to the rear of the main structure. A fence sixty (60) in- ches in height may be erected along the end side yards from the rear of main structure forward to front building line. Any fence or screen constructed in the required front yard must have Plan- ning Commission approval as to location, height, material and construction. 8. Minimum Size of Single Unit Dwelling. Each single unit dwelling e /yke 4 t.z( shall contain a gross floor area of not less than $dc+ (6a0 =) square feet, excluding steps, porches, or carports. 9. Maximum Acreage Allowed. The maximum acreage to be developed s shall not exceed a total of five (5) acres, 10. Maximum Length of Zero Lotline Housing. There shall be a max- imum of two hundred (200) feet allowed of zero lotline housing construction, and then a break is required spacing buildings as per requirements set forth in this ordinance. 11. Off Street Parking. Each zero lotline dwelling unit shall have one (1) off - street parking space provided. On lots larger than twenty (20) feet, two (2) off- street parking spaces shall be re- quired. 12. Corner Visibility. On a corner lot, within the areas formed by the right -of -way lines of intersecting streets and a line joining points on such right -of -way lines at a distance of twenty -five (25) feet from their intersection, there shall be no obstruction to vision between a height of two (2) feet and a height of ten (10) feet above the average grade of each street at the center- line thereof, except that street name signs, fire hydrants, street lighting poles, and associated appurtenances thereto shall be permitted within this area 13. Streets. Streets are to be twenty -seven (27) feet wide and spec- ifications and /or designs are to be the same as required in present ordinance covering same. 14. Sidewalks. Sidewalks shall be required in front of every zero 453 . PAGE FOUR ORD. NO. lotline dwelling unit; minimum /standard size forty -two (42) inches. 15. Firewalls. Zero lotline housing units shall be separated with a firewall to be inspected and approved by code enforcement director of the city; specifications to be determined by Southern Building Code regulations. Section 4. This ordinance being necessary for the immediate pres- ervation of the health, safety and morale of the citizens of the City of Jacksonville, Arkansas an emergency is hereby declared to exist and this ordinance shall take effect immediately upon its passage and approval.
