ORDINANCE NO. 1567 (#03 - 2017)
AN ORDINANCE AUTHORIZING A LEASE AGREEMENT FOR UPGRADES AND
IMPROVEMENTS TO EQUIPMENT AND INTERNET SERVICE FOR CITY HALL, THE
POLICE DEPARTMENT, AND OTHER CITY FACILITIES THROUGH A THREE (3)
YEAR LEASE AGREEMENT; PROVIDING FOR PAYMENT OF THE LEASE
OBLIGATION; DECLARING AN EMERGENCY; AND, PRESCRIBING OTHER
MATTERS RELA TING THERETO.
Whereas, the City Council of the City of Jacksonville, Arkansas (the "City"), has
continually fought internet service difficulties at several of its locations, particularly City Hall
and the Police Department. In examining and researching the difficulties, our Information
Technologies Department (IT) has determined a manner in which to improve said service
and save funds from current lesser quality services;
Whereas, in doing so, IT sought information and pricing from the major providers in
the area, CenturyLink, Comcast, Ritter Communications, and Windstream. Service to
improve the Site to Site Circuit with improved fiber optics connections between City Hall and
the Police Department was sought, as was improved and greater internet speeds at the
Police Department so as to reduce overall costs incurred; and,
Whereas, Ritter Communications provided information and a proposed Lease
Agreement at a savings of more than Nine Hundred Thirty Dollars ($930.04) per month than
our current costs with the needed improvements and connectivity. As a result, a
competitive bidding process would be costly, counter-productive to the City's current needs,
and will allow the City to save over Thirty-three Thousand Dollars ($33,440.00) over the next
Three (3) years.
NowTHEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF]ACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for purchase and maintenance of
improved Site to Site Internet Service with fiber optics connections for City Hall, the Police
Department, and other City facilities as outlined on the attached would be costly and
non-productive, making said competitive bidding unfeasible and impractical. Competitive
bidding is hereby waived, pursuant to RCA §14-58-383, to authorize contracting with Ritter
Communication for a Lease Agreement for said as outlined on the attached Information
Sheet. Authorization is hereby given to the Mayor and/or his authorized representative(s)
to enter into contract with Ritter Communications for said equipment improvement and
improved services, a 1 for a total cost not to exceed Two Thousand Four Hundred Ninety-nine
and 99/100 Dollars ($2,499.99) per month for the next Thirty-six (36) months, plus
applicable taxes.
SECTION TWO; The City Council hereby finds that the needed upgrades
and improved internet provider services are necessary and will save funds from the 2017
budgeted amounts previously approved by the Council.

SECTION THREE: The provisions of this Ordinance are hereby declared to
be separable and if any provision shall for any reason be held illegal or invalid, such holding
shall not affect the validity of the remainder of this Ordinance.
SECTION FOUR, All Ordinances and Resolutions or parts thereof in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION FIVE: This Ordinance, because of the immediate need to
improve the internet services addressed herein for public safety and financial savings,
requires that an emergency is hereby declared. As a result, this Ordinance shall take effect
immediately upon passage and publication, as provided by and subject to the requirements
of applicable law.
