15 JUNE 18 CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING JUNE 18, 2015 7:00 P.M. – 7:10 P.M. REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in regular session on June 18, 2015 at the regular meeting place of the City Council. Alderman Howard delivered the invocation and Mayor Fletcher led a standing audience in the “Pledge of Allegiance” to the flag. ROLL CALL: Aldermen: Elliott, Sansing, Ray, Mashburn, Traylor, Smith, and Howard answered ROLL CALL. Mayor Fletcher also answered ROLL CALL declaring a quorum. PRESENT TEN (7), ABSENT (3). Others present for the meeting were: City Attorney Robert Bamburg, Director of Administration Jim Durham, Finance Director Cheryl Erkel, Human Resource Director Jill Ross, City Engineer Jay Whisker, Public Works Director Jim Oakley, Parks and Recreation Director Kevin House, Police Chief Kenny Boyd, Fire Chief Alan Laughy, CDBG Director Theresa Watson, IT Director Scott Rothlisberger, 911 Director Tabby Hughes, Jennifer Martin, Johnny Simpson, and interested citizens, and members of the press. PRESENTATION OF MINUTES: Mayor Fletcher presented the minutes of the regular City Council meeting of May 21, 2015 for approval and/or correction at the next regularly scheduled City Council meeting. APPROVAL AND/OR CORRECTION OF MINUTES: Alderman Elliott moved, seconded by Alderman Howard that the minutes of the regular City Council meeting of 7 May 2015 be APPROVED. MOTION CARRIED. CONSENT AGENDA: REGULAR MONTHLY REPORT/POLICE DEPARTMENT Alderman Ray moved, seconded by Alderman Sansing to approve the Regular Monthly Report for May 2015 regarding annual crime statistical comparisons. REGULAR MONTHLY REPORT/FIRE DEPARTMENT Alderman Ray moved, seconded by Alderman Sansing to approve the regular monthly report for May 2015 from the Jacksonville Fire Department, reflecting a fire loss of $6,000.00 and a savings total of $1,714,000.00. REGULAR MONTHLY REPORT/ENGINEERING DEPARTMENT Alderman Ray moved, seconded by Alderman Sansing to approve the regular monthly report for May 2015. PERMITS/LICENSE ISSUED INSPECTIONS PERFORMED Building Permits 12 Building Inspections 67 Business Licenses 12 Electrical 27 Plumbing 25 HVACR 13 REGULAR MONTH REPORT/ANIMAL CONTROL Alderman Ray moved, seconded by Alderman Sansing to approve the regular monthly report for May 2015. WATER DEPARTMENT: WASTEWATER DEPARTMENTS: FIRE DEPARTMENT: POLICE DEPARTMENT: PRESENTATION for JAG grant public comments welcomed Chief Boyd explained that the Bureau Justice Assistance is a federal program that assists state and local law enforcement with funds. He related that each year the Edward Byrne JAG Grant is made available and an agency is selected for the application process. He related that it is a non-matching grant, announcing that the Jacksonville Police Department was awarded $20,159.00. He explained that the Grant funds would be used to replace out of date tasers and purchase additional body cameras. In response to a question from Alderman Mashburn, Chief Boyd related that the Grant monies would not be enough to replace all the tasers. SANITATION DEPARTMENT: PARKS & RECREATION: 2 CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING JUNE 18, 2015 7:00 P.M. – 7:10 P.M. PLANNING COMMISSION: ORDINANCE 1531 (#11-2015) AN ORDINANCE MODIFYING THE JACKSONVILLE MUNICIPAL CODE §17.04.020 \[JURISDICTION-SUBDIVISION REGULATIONS\]; ADOPTING MODIFICATIONS TO THE CITYS’S EXTRA TERRITORIAL PLANNING JURISDICTION; AND, FOR OTHER PURPOSES. Alderman Ray moved, seconded by Alderman Mashburn that Ordinance 1531 be placed on FIRST READING. ROLL CALL: Aldermen Elliott, Bolden, Sansing, Ray, Mashburn, Traylor, Smith, and Howard voted AYE. NAY (0). MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1531. City Attorney Bamburg related that formerly state law provided that cities have a five mile extra territorial jurisdiction; however that has recently changed to one mile, which is now mandated and observed by all cities. City Engineer Whisker demonstrated the extra territorial jurisdiction area regarding the surrounding cities. He then answered that when two cities share the extra jurisdictional area, it is split equally. Alderman Ray moved, seconded by Alderman Bolden to APPROVE Ordinance 1531 on FIRST READING and suspend the rules and place Ordinance 1531 on SECOND READING. ROLL CALL: Alderman Elliott, Bolden, Sansing, Ray, Mashburn, Traylor, Smith, and Howard voted AYE. NAY (0). MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1531. Alderman Ray moved, seconded by Alderman Bolden to further suspend the rules and place Ordinance 1531 on THIRD AND FINAL READING. ROLL CALL: Alderman Elliott, Bolden, Sansing, Ray, Mashburn, Traylor, Smith, and Howard voted AYE. NAY (0). MOTION CARRIED. Whereupon City Attorney Bamburg read the heading of Ordinance 1531. Alderman Ray moved, seconded by Alderman Sansing that Ordinance 1531 be APPROVED AND ADOPTED. MOTION CARRIED. TH ORDINANCE 1531 (#11-2015) APPROVED AND ADOPTED THIS 18 DAY OF JUNE, 2015 GENERAL: RESOLUTION 729 (#05-2015) A RESOLUTION AUTHORIZING THE CITY CLERK TO DESTROY SPECIFIED CITY DEPARTMENTAL RECORDS; AND, FOR OTHER PURPOSES. Alderman Ray moved, seconded by Alderman Elliott to read Resolution 729 (#05-2015). MOTION CARRIED whereupon City Attorney Bamburg read the heading of Resolution 729 (#05-2015) 3 CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING JUNE 18, 2015 7:00 P.M. – 7:10 P.M. City Attorney Bamburg related that Resolution 729 is a standard housekeeping item of business, clarifying that this authorizes the City Clerk and staff to destroy old records no longer needed. He noted that a list of those records have been provided as part of the Resolution. Alderman Ray moved, seconded by Alderman Elliott to approve Resolution 729 (#05-2015) in its entirety. MOTION CARRIED. Mr. Floyd McMurtrey stated he represents the ASPCA and is a representative of the humane society of the United States of America. He related that he has asked the City of Jacksonville not to euthanize animals. He then added that he has a big concern with the law enforcement and that he is being harassed. He said that law enforcement has cameras and is watching him 24 hours a day, adding that the City has a satellite that watches him. Mr. McMurtrey became inflamed and loud. Mayor Fletcher attempted to calm Mr. McMurtrey by assuring him the City did not have cameras or a satellite watching him. Mr. McMurtrey continued to raise his voice and argue with Mayor Fletcher. Police Officers escorted Mr. Floyd McMurtrey from the City Council Chamber and off City Hall property.
