0396 ORDINANCE NO. r N2 / y'
AN ORDINANCE AMENDING §2.28.010 and §2.28.020 OF THE MUNICIPAL
CODE OF THE CITY OF JACKSONVILLE, ARKANSAS- DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES.
W H E R E A S , the State of Arkansas Legislature passed Act No. 541
in 1975, providing for an increase in the permitted number of Hospital
Commissioners; and
• WHEREAS , the City Council of the City of Jacksonville, Arkansas
has increased the number of Commissioners; and
W HE R E A S , the Municipal Code of the City of Jacksonville,
Arkansas, does not reflect said increase:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS,
that:
Section 1. Section 2.28.010 of the Municipal Code of the City of
Jacksonville, Arkansas, is amended to read as follows:
"There is created a commission to be known as the Jackson-
' ville Municipal Hospital Commission and to be composed of seven
citizens who are qualified electors of the city."
Section 2. Section 2.28.020 of the Municipal Code of the City of
Jacksonville, Arkansas, is amended to read as follows:
"Said commissioners shall be appointed by the mayor and
confirmed by a majority vote of the duly elected and qualified
members of the city council and shall hold office for a term of
five years; provided however, that those commissioners first
appointed and confirmed shall serve for terms to be designated
by the mayor and city council of one, two, three, four and
five years each. In the event a vacancy occurs on the commis-
sion, it shall be filled by appointment by the mayor subject to
the approval of a majority vote of the duly elected and qualified
members of the city council. In the event the commission is in-

creased by two, the two new commissioners shall serve for a term
of five years, provided, however, that of those two new commis-
sioners appointed, one shall serve for a term of four years and
one for a term of five years to be designated by the mayor and
city council. Each commissioner shall file the oath required by
law in the state of Arkansas of public officials."
Section 3. This ordinance being necessary for the preservation of
the public health, safety and welfare, an emergency is hereby declared
to exist and this ordinance shall become effective immediately,
