A RESOLUTION SUPPORTING PASSAGE OF APPROPRIATE
LEGISLATION TO ENCOURAGE PROPER ASSESSMENT AND
COLLECTION OF SALES TAX FROM ALL INTERNET/ONLINE SALES
TQ CREATE A FAIR AND FREE MARKET FOR ACL BUSINESSES AND
CONSUMERS REGARDLESS OF THE LOCATION OF SALES AND
BUSINESS TRANSACTIONS; AND, FOR OTHER PURPOSES,
WHEREAS, the City of Jacksonville recognizes that legislation
frequently referred to as the Marketplace Fairness and Remote Transactions
Parity Act ("this Legislation") is being considered by Congress for application
throughout the United States;
WHEREAS, this Legislation was considered by the 2017 Arkansas
General Assembly, and such Legislation would provide States the authority to
impose local and State taxes already in place on out—of-state online retailers;
WHEREAS, this Legislation would require retailers, regardless of their
physical location, to collect and remit sales tax to States and local
governments sales taxes;
WHEREAS, currently, out-of-state internet retailers are able to exploit
a pre-internet loophole and evade collection and payment of State and local
sales taxes, even on the same merchandise as local retailers, putting local
retailers at a disadvantage; and,
WHEREAS, this legislation is not a new tax/increase, but rather
enables States and local governments to collect sales taxes already due but
currently being uncollected or paid by out -of -State internet retailers. It is
hoped that this legislation would generate more sales, more sales tax
revenues, and encourage more local retailers to create additional }obs for
local citizens and infuse more money into the local economies throughout
the State of Arkansas.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITYOFJACKSONVILLE, ARKANSAS, THAT:
SECTION ONE. We hereby encourage and urge all members
of Congress, particularly the Arkansas Congressional delegation, and the
Arkansas General Assembly to support passage and vote in favor of this
Legislation requiring the collection and remittance of State and local sales
taxes by ALL retailers regardless of sales locations. We encourage the

creation of a fair and competitive free market, giving ALL businesses an
equal opportunity to compete, improve safes, and create new jobs.
SECTION TWO: We hereby urge Governor Asa Hutchinson
to call for a Special Session of the Arkansas General Assembly as quickly as
possible to address this most important issue for the benefit of all of
Arkansas' local retailers and businesses as well as its citizens.
SECTION THREE: This Resolution, being necessary for the
betterment of the public utility and in the continuing purpose of protecting
the public's health and safety, shall be in effect from and after its date of
adoption.
SECTION FOUR: Any other Resolutions in conflict herewith
are hereby repealed to the extent of said conflict. This Resolution shall be in
effect from and after its date of passage.
