AN ORDINANCE FIXING RATES FOR SERVICES FURNISHED BY THE WATER
AND SEWER DEPARTMENTS OF THE CITY OF JACKSONVILLE, ARKANSAS;
PRESCRIBING OTHER MATTERS RELATING THERETO AND DECLARING AN
EMERGENCY.
WHEREAS, the City of Jacksonville has conducted a cost of service
study which indicates that customers other than Little Rock Air Force Base are
paying less than the cost to the City of Jacksonville to provide them with water
and sewer service;
WHEREAS, the City of Jacksonville Water and Sewer Departments
have been operating at a deficit since beginning bond payments in July, 1973 for
the most recent water improvement project;
WHEREAS, City Ordinance No. 287 requires that water rates be suf-
ficient to provide revenues in excess of the monthly bond payments so as to allow
the monthly deposit of a sum equal to 20 per cent of the next installment of interest
and 10 per cent of the next installment of principal;
WHEREAS, the failure of the City Council to fix water and sewer
rates as hereinafter reflected could possibly vest ownership of the City owned
Water Department facilities with the bondholders for the aforementioned water
improvement project;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, that
Section 1. Section 1 of Ordinance No. 268 and Section 13.16.010 of
the Municipal Code is amended to read as follows:
"Section 1. (313.16.010) Water Rates. That the following monthly
rates are fixed as rates to be charged for water furnished by the waterworks
system of the City, which rates the council finds and declares to be reasonable
and necessary minimum rates to be charged, effective December 1, 1975.

SIZE OF METER WILL BE DETERMINED BY THE CITY.
No more than one residential unit or one commercial or industrial
establishment shall be served through one meter except where this condition now
exists or except where special conditions make it more practical to serve through
one meter.
Where more than one residential unit (e.g., residence, apartment,
mobile home, housekeeping or other unit) or commercial or industrial establish-
ment is served through one meter, both the minimum charge and the consumption
blocks set forth hereinabove will be increased in proportion to the number of such
units served through the one meter. Where more than one meter is required to
serve a single commercial or industrial establishment the meter size will be
combined for the purpose of determining the minimum rate. Where multiple
residential units are served through one meter the minimum charge for each unit
will be based upon the residential minimum for a 5/8 inch meter.
Special Rates. Because of governmental procurement regulations,
the water rates for Little Rock Air Force Base shall be governed by existing
contract, which shall be subject to revision along with all other rates to reflect
changes in the cost of service.
Outside City Limits. Rates for customers located outside the City
limits shall be increased fifty per cent (50 %) over rates applying to customers
located inside the City limits.
Section 2. That part of Section 3 of Ordinance No. 268 and Section
13.16.060 of the Municipal Code which pertains to sewer rates is amended to read
as follows:

"Sanitary sewer charges shall be as follows: Each residential unit
shall pay a flat rate of $2.25 per month. Each commercial and /or industrial
establishment having at its point of discharge a BOD of less than 250 mg - 1
shall pay either $3.50 or 30 per cent of the water bill (not including sales tax)
each month, whichever is greater.
Commercial and industrial establishments having at its point of dis-
charge a BOD in excess of 250 mg - 1 shall pay a charge of ten cents per pound
of BOD . Standard methods for examination of water and waste water as pub-
lished by the American Public Health Association, shall be the sole and final
determining factor as to the conformance, or failure thereof, of a waste water
discharge. All such determinations shall be based on the discharge prior to its
point of delivery to the public facilities without regard to flow, velocity, or dilution
existing in the public system at the point of discharge. Any existing contracts
with customers governing sewer service shall remain in effect.
Residential minimum sewer rates shall be charged for each residential
unit such as a residence, apartment, mobile home or housekeeping unit, regard-
less of the number of units in a building or at a given location. Where more
than one commercial or industrial establishment is served through one water
meter, the minimum sewer rate and the consumption blocks will be increased in
proportion to the number of units served through said water meter."
