AN ORDINANCE AMENDING AND CREATING JMC if 18.54. TO ALLOW
PERMITTED USE OF OFF PREMISES RETAIL AND WHOLESALE ALCOHOL
DISTRIBUTORSHIPS AND SALES IN A NEWLY CREATED C -5 ZONING
CLASSIFICATION; A M EN D I N G JM C J 18.68.050; A M EN D I N G J M C 1 18.76;
AMENDING AND MODIFYING THE LAND USE MAP OF THE CITY OF
JACKSONVILLE; AND, FOR OTHER PURPOSES,
WHEREAS, provisions in current zoning classifications do not provide for an
appropriate zone classification for permitted use of off premises retail and wholesale
alcohol distributorships and sales as an authorized permitted use within a zoning
classification, and it has been deemed appropriate and beneficial to do so to match
existing development within areas recently annexed into the City.
NOW THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL 6F THE CITY 6F JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: JMC § 18.54.010 (Purpose) shall be created to include
the following:
The C -5 zoning district is designed to accommodate existing and/or new
development of a mixed highway commercial area for the distribution and /o retail
sales of off premises retail and wholesale alcohol and provide for the integrity and
protection of residential and commercial zoning districts.
SECTION TWO: JMC § 18.54.020 (C -5 - Permitted Uses) shall be created
to include the following:
Alcohol Distributorships
Off - premises Retail Alcohol Sales
Off Premises Wholesale Alcohol Sales
SECTION THREE: JMC § 18.54.030 (C -5 — Conditional Uses) shall be
created to include the following:
Any use permitted under Zoning Districts: C -1, C -2, C -3, and C -4.
SECTION FOUR: JMC § 18.54.040 (C -5 — Dimensional Requirements) shall
be created to include the following:
For Dimensional requirements, C -5 District, see Chart No. 1, Chapter 18.68.
SECTION FIVE: JMC § 18.54.050 (C-5 — Parking and Loading
Requirements) shall be created to include the following:
For Parking and Loading Requirements, C -5 District, see Chart No. 1, Chapter
18.68.

SECTION SIX: JMC § 18.54.060 (C -5 - Signs) shall be created to include
the following:
For provisions regarding signs in the C -5 District, see JMC § 18.76. et. seq.
SECTION SEVEN: JMC § 18.54.070 (C -5 — Landscaping Requirements) shall
be created to include the following:
For provisions regarding landscaping requirements within the C -5 District,
§§
please refer to JMC 1620 et. seq., with particular emphasis on those requirements
outlined in 16.20.044.
SECTION EIGHT :: JMC § 18.54.075 (C -5 — Limitations) shall be created to
include the following:
No real property located outside of the legally defined and specified
boundaries of the property/territory formerly known as the Old Gray Township may
be classified, modified, or zoned as a C -5 Zoning District.
SECTION NINE: JMC § 18.68.050 (Dimensional Requirements — C -5)
shall be created to include the following:
Maximum Building Height: Stories: 2 1/2; Feet: 35.
Minimum Lot Sizes: Lot Width: N /A; Lot Depth: N /A.
Minimum Yard Requirements: Front: 25'; Rear: 10'; Side: 15'.
Maximum Lot Coverage by Building (Percentage): 35 %.
Minimum Parking & Loading Requirements:
Off Street Parking — 1 space per 200 SF of bldg.
Off Street Loading — 1 space per 10,000 SF of bldg.
SECTION TEN: JMC § 18.76.040 (Signs — Zoning Requirements — C -5)
shall be created to include the following:
1) Each business located within this zone shall be allowed One (1) on-
site sign designating the business name, products sold, or services
rendered at the location. The area of the attached on -site sign shall not
exceed Two Hundred Square Feet (200 SF), the height of the sign shall
not exceed Ten Feet (10') above the height of the structure of Forty-five
Feet (452, whichever is lower, and the front edge of the sign shall not
extend beyond the applicable setback requirement(s); and,
2) An additional on -site freestanding sign of equal size will be allowed
provided it has either a minimum clearance of Five Feet (5') from a point
Three Feet (3') above the ground to the bottom of the sign at the leading
edge of the sign located adjacent to the front property line or has a
minimum setback of Ten Feet (10') from the front property line to the

leading edge of the sign. However, if the business in question is located
within a Shopping Center, any sign must be attached to a Shopping
Center sign advertising the business(es) located within or upon the
Shopping Center property. In any circumstance, the height of the sign
shall not exceed Ten Feet (10') above the height of the structure or
Forty-five Feet (45 '), whichever is lower.
SECTION ELEVEN: The attached map of the annexed territory reflects
appropriate zoning classifications designated to all properties included in the recent
Hwy. 67/167 business corridor annexation.
SECTION TWELVE: All Ordinances or parts thereof in conflict herewith
are hereby repealed to the extent of said conflict.
SECTION THIRTEEN: This Ordinance shall take effect from and after its
date of passage, subject to and in compliance with all applicable laws.
