0303 ORDINANCE 3o 3 ELY ORDINANCE .ADJUSTING THE 1573 \PPROPRI.ATED BUDGET, BY DEPARTMENTS, MINDING ORDINANCE N0. 283 to EIGHT HUNDRED T`U RTY -S VN OUSAND, SEVEN HUNDRED SEVENTY DOLLARS ($837,770.00):/MB n ' fI nE ifienDRED NINETY - FIVE THOUSAND, NINE HUNDRED EIGHTY DOLLARS ($395,980.00) IN STREET DEPARTMENT; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. ;)HEREAS, the City Council of the City of Jacksonville, Arkansas, approved the appropriated budget for 1973 by departments, and HERE'S, the City Council has determined for various reasons, and to conform to the needs of the City, in keeping with the city revenue available, and WHEREAS, the City Council deems it necessary at this time to re- adjust the 1973 appropriated budget by departments. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS; SECTION 1: That from and after the passage and approval of this ordinance the 1973 appropriated budget, by department, shall be as follows: DEPARTMENT INCREASE ADJUSTED BUDGET MUNICIPAL COURT $ 1,000.00 $ 22,350.00 POLICE DEPARTPIENT 27,700.00 222,800.00 FIRE DEP ?.RT`ENF 11,000.00 168,600.00 ANIMAL SHELTER 1,500.00 9,687.50 INSURANCE MATCH 1,800.00 4,392.00 $43,000.00 $428,329.50 STREET D'EPARTMEN.. $29,980.00 $ 395,980.00 SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. The City Council has determined that it is imperative that the city government operate in an efficient and orderly manner, and a budget be adopted and the monies appropriated therefore in accordance with the laws of the State of Arkansas before the end of the calendar year. THEREFORE, an emergency is hereby declared to exist, and this ordinance being necessary for the immediate preservation of the public peace, health and safety, shall be in full force and effect from December 1, 1973, and after its passage and approval. H �. c BEN, 1.1A OR � �tJ ' u` ATTESTE _ ice . r LO' /. r , p• ' CLERK • ORDINANCE NO. ,,9p,3 AN ORDINANCE FIXING AND IMPOSING AN ADDITIONAL ASSESSMENT TO BE PAID THE CITY OF JACKSONVILLE, ARKANSAS BY ARKANSAS LOUISIANA GAS COMPANY AND THE METHOD OF PAYMENT THEREOF, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES WHEREAS, Arkansas Louisiana Gas Company is duly authorized to construct, operate, maintain and extend a gas system and to sell, furnish, transmit and distribute natural gas and energy in the City of Jacksonville, Arkansas (hereafter referred to as "City "), to the City of Jacksonville, Arkansas and to the citizens residing therein; WHEREAS, said Arkansas Louisiana Gas Company is now providing gas service to the City and its inhabitants and is occupying the streets, alleys and other public property of the City of Jacksonville, Arkansas, pursuant to said authority; WHEREAS, the City requires additional revenued for payment of increased salary requirements for City employees and other municipal functions and service and desires to increase the payment of special taxes, charges and assessments paid by the said Arkansas Louisiana Gas Company pursuant to the right of the City to levy such additional assessments, and WHEREAS, the City recognizes and accepts the purposes and results of decisions of the Arkansas Public Service Commission and the Arkansas Supreme Court requiring that the charges for service by a utility to customers in the City be adjusted to adequately reflect any additional amounts of assessments imposed by the City in excess of a standard level paid in other municipalities to avoid discrimination among customers of the utility; hbw, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, That: Section 1. The manufacture sale, furnishing, transmission and distribution of natural gas and energy by Arkansas Louisiana Gas Company within the City is hereby declared to be a special privilege and for such privilege the Arkansas Louisiana Gas Company shall pay to the City, in addition to current payments being made to the City in the form of $2.00 per meter setting , an additional special assessment, tax, charge or imposition as follows: the company for the PAGE ORD. BOOK # a • > year 1974 shall pay an additional sum of Forty Thousand and no /100 Dollars ($40,000.00), payable in approximately equal quarterly installments beginning March 15, 1974. Section 2. All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. It is hereby found by the City Council that there is an urgent need for additional revenues for the City. Therefore, an emergency is declared to exist, and this ordinance being necessary for the preservation and advancement of the public peace, health, safety and welfare, shall be in full force and effect from and after the date of its approval, retroactive to January 1., 1974.
