0295 ■ .. • ORDINANCE NO �C AN ORDINANCE PROVIDING FOR THE RAZING AND REMOVAL OF A BURNED OUT RESIDENCE LOCATED AT 118 NORTH CIRCLE IN THE CITY OF JACKSONVILLE, ARKANSAS; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS, provisitn is made in Arkansas Statutes Ann. , Sec. 19 -2803 to allow cities of the first class to provide by ordinance the manner for removing buildings or houses that have become dilapidated, un- sightly, unsafe, unsanitary, obnoxious or detrimental to the public welfare; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION 1. That W. W. Nixon, Jr. and Esther O. Nixon, his wife, are the record owners of the following described property but have deeded their interest in same to Patsy Bounds, who has not recorded her deed, and that said owners are hereby ordered to remove or raze the buildings upon said property within thirty (30) days from the effective date of this ordinance. SECTION 2. That said property is known as 118 North Circle, Jacksonville, Arkansas, more particularly described as Lot 492, Sunnyside Hills Addition to the City of Jacksonville, Arkansas and that the structures currently situated on said premises are hereby declared to be a structural, fire and health hazard. SECTION 3. That the City Attorney is hereby directed to institute such legal proceedings as may be necessary in order to enforce the provisions of this ordinance, and to remedy the dangerous and un- sightly conditions brought about as a. result of the failure of the owners to properly keep up said property. SECTION 4. That said legal proceedings shall provide that unless the houses are razed within a certain period, to be allowed by the court, the City of Jacksonville be authorized to raze said property and have a lien upon the real property for the cost of removing said house. That all ordinances and parts of ordinances in conflict herewith are hereby repealed and, unless the provisions of this ordinance are put into effect immediately, the public peace, heal* and safety of the people of Jacksonville will be adversely affected; therefore, an emergency is hereby declared to exist, and this ordinance shall be in full force and effect from and after its passage and approval.
