0268 41 • a '1 ORDINANCE NO. ci (pS� V AN ORDINANCE FIXING RATES FOR SERVICES FURNISHED BY THE WATERWORKS AND SEWER SYSTEMS OF THE CITY OF JACKSONVILLE, ARKANSAS; PRESCRIBING OTHER MATTERS RELATING THERETO AND DECLARING AN EMERGENCY. WHEREAS, it has been determined by the City Council of the City of Jacksonville, Arkansas (hereinafter called "City") that certain improvements to the Waterworks and Sewer Systems are necessary in order to adequately provide • for the needs of the inhabitants of said City; and f` l WHEREAS, the City does not have available sufficient funds with which to accomplish the construction of said improvements, but it has been determined by the Council that said funds can be made available by the issuance of Water— works and Sewer Revenue Bonds; and WHEREAS, the Council has determined that it is not feasible to issue such revenue bonds payable from income of the Waterworks and Sewer Systems derived from the present schedule of water and sewer rates and has determined that a new and revised schedule of such rates is necessary and essential; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, that: Section 1. Water Rates. That the following monthly rates be, and they are hereby, fixed as rates to be charged for water furnished by the Waterworks System of the City of Jacksonville, Arkansas, which rates the Council hereby finds and declares to be reasonable and necessary minimum rates to be charged: BASIC RATE FOR ALL CUSTOMERS First 3,000 gallons $2.25 (Minimum) Next 7,000 gallons 0.65 per M Next 10,000 gallons 0.55 per M Next 30,000 gallons 0.50 per M Next 50,000 gallons 0.45 per M Next 400,000 gallons 0.40 per M Next 500,000 gallons 0.37 per M Next 5,000,000 gallons 0.35 per M All Over 6,000,000 gallons 0.33 per M In addition, a meter service charge will be added to the rate computed as shown above: 1 __PAGE tf -� \.1 �t1 i 1”,j(,‘, Page Two • 1 5/8" Meter None 1" Meter $ 1 .00 per month 1 -1/2" Meter 2.00 per month 2" Meter 2.50 per month 4" Meter 5.00 per month 6" Meter 10.00 per month i Section 2. Water Meter Connection Fees. J -i \ \ All meters outside the corporate limits shall first be approved by the City Council and the connection fee shown above shall be doubled or shall be the cost of installation, whichever is greater. Apartment houses and /or mobile home parks shall pay the appropriate water connection fee and $20.00 for each additional unit to be served. 1 Apartment houses and /or mobile home parks located outside the City limits shall pay double the above stated connection fees. f Before an order to turn on water shall be issued, each customer for new water service shall place on deposit with the Water Company a sum (meter deposit) corresponding with the meter deposit for the meter size in place or to be placed on the water service line of the new customer. This meter deposit shall be returned to the customer, less any amount due for water and sewer service, upon discontinuation of the service. A $3.50 service charge (cut -on cut -off) fee shall be paid concurrently with the aforestated meter deposit fee. Section 3. Sewer Rates. Sanitary sewer charges shall be computed as follows: $1.50 per customer minimum or 30% of the water bill each month, whichever is greater. The sanitary sewer tie -on fee shall be $50.00 except for apartment houses and /or mobile home parks which shall pay $50.00 for the first unit and _ . . ,, , ? PAGE #1_d__. Page Three $10.00 for each additional unit connected to the system. Apartment houses and /or mobile home parks located outside the City limits shall pay double the above stated connection fees and shall first be approved by the City Council . Section 4. Except as hereinabove stated, existing customers outside the present corporate limits shall be charged the same monthly rates as customers within the corporate limits. Section 5. That all bills for charges for water and sewer use shall be computed and rendered monthly, and shall be due and payable on or before the 15th day following the date of billing. A ten (10) per cent penalty charge shall be added to any bill not paid on or before the 15th day following the date of billing. If any bill is not paid by the 25th day following the date of billing, water service shall be discontinued and the premises shall be disconnected from the water sys- tem. Should any water service be so discontinued or premises be so disconnected, and water service subsequently be requested by the same customer whose service was so discontinued or disconnected, the bill involved must be paid in full with penalty and a service charge of $3.50 shall be made for restoring or reconnect- ing the water service. Reasonable effort shall be made to notify customers of delinquency in payment of bills, but failing payment within the 25th day grace period mentioned herein, water service shall be terminated impartially unless extenuating circumstances such as a death in the family, serious illness or other similarly trying condition exists. Section 6. It shall be a misdemeanor to disturb, tamper with, or des- troy any property belonging to the City of Jacksonville, Arkansas, now vested in the Jacksonville Water & Sewer Department, that is to say, it shall be a mis- demeanor to disturb, tamper with or destroy water meters, fire hydrants, main pipe lines, valves, pumps, waterworks equipment and property of the Jackson- ville Water & Sewer System. Each day that the offense exists or continues shall constitute a separate offense. Any person convicted of such misdemeanor shall be fined a sum of not less than Ten Dollars ($10.00) nor more than Fifty Dollars ($50.00) for each offense. E ., , . ._ 1..4.x.,.,.._. r;��C ��_ 3 .._. __. _ Page Four Section 7. The provisions of this ordinance shall be in full force and effect as of August 1, 1972. Section 8. That the provisions of this Ordinance are separable, and if a section, phrase or provision shall be declared invalid, such declaration shall not affect the validity of the remainder of this Ordinance. Section 9. That all Ordinances and Resolutions and parts thereof in conflict herewith are hereby repealed to the extent of such conflict. Section 10. That the revision of water and sewer rates is immediately necessary in order to finance needed improvements to the Waterworks and Sewer Systems of the City, and, therefore, this Ordinance being necessary to preserve the peace, health and safety of the inhabitants of the City of Jacksonville, an emer- gency is hereby declared to exist, and this Ordinance shall be in force and take effect immediately from and after its passage, and said rates shall be applicable beginning on ail / and payable with Water and Sewer bills rendered on or afte� i , 1972.
